Uttar Pradesh Co-operative Societies (Amendment) Act, 2000

(As passed by the Uttar Pradesh Legislature)An Act further to amend the Uttar Pradesh Co-operative Societies Act, 1965. It is hereby enacted in the Fifty-first Year of the Republic of India as follows:- 1. Short title and commencement. - (1) This Act may be called the Uttar Pradesh Co-operative Societies (Amendment) Act, 2000. (2) It shall be deemed to have come into force on January 1, 2000.

|Statement of Objects and Reasons. - The terms of Administrator or Committee of Administrate appointed under Section 29 of the Uttar Pradesh Cooperative Societies Act, 1965 expired on December 31, 1999 and Committee of Management in certain cases could not be reconstituted by holding the election of Cooperative Societies within the time stipulated in sub-section (3) of the said section. It was, therefore, decided to amend the said Act to provide for,-
(a) the extension of the term of Administrator or the Committee of Administrators for a further period of six months;
(b) the extension of the period from eighteen months to two years for reconstitution of Committee of Management by the Administrator or the Committee of Administrators as the case may be;
(c) the validation of the powers exercised, functions performed and duties discharged by the Administrator or Committee of Administrators appointed under Section 29 of the said Act on or after January 1, 2000.Since the State Legislature was not in session and immediate action to implement the aforesaid decision was necessary, the Uttar Pradesh Co-operative Societies (Amendment) Ordinance, 2000 (U.P. Ordinance 5 of 2000) was promulgated by the Governor on February 15, 2000. This Bill is introduced to replace the aforesaid Ordinance.
