(As passed by the Uttar Pradesh Legislature)Received the assent of the Governor on December 16, 2003 and published in the Uttar Pradesh Gazette, Extraordinary, Part 1, Section (Ka), dated 17th December, 2003, pages 3-5. An Act further to amend the Uttar Pradesh Co-operative Societies Act, 1965. It is hereby enacted in the Fifty-fourth Year of the Republic of India as follows:- 1. Short title and commencement. - (1) This Act may be called the Uttar Pradesh Co-operative Societies (Amendment) Act, 2003. (2) It shall be deemed to have come into force on October 28, 2002.

|Statement of Objects and Reasons. - With a view to comply with the orders passed from time to time by the High Court in writ petitions filed in relation to the recruitment and service conditions of Co-operative Amins and other staff and the judgment pronounced on appeal thereon it was decided to amend the Uttar Pradesh Co-operative Societies Act, 1965 (U.P. Act 11 of 1966) to provide for,-
(a) appointment of Amins and other staff for collection of an amount due to a Co-operative Society or for execution of a process issued in the proceedings of execution of an award, order or certificate for recovery under clause (a) or clause (b) of Section 92 of the said Act;
(b) empowering the State Government to regulate by rules the recruitment and service conditions of Amins and other staff;
(c) establishment of the Co-operative Collection Fund and utilisation thereof.Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Co-operative Societies (Second Amendment) Ordinance, 2002 (U.P. Ordinance 18 of 2002) was promulgated by the Governor on October 28, 2002. This Bill is introduced to replace the aforesaid Ordinance.
