An Act further to amend the Uttar Pradesh Cooperative Societies Act, 1965. It is hereby enacted in the Fifty-ninth Year of the Republic of India as follows:- 1. Short title. - This Act may be called the Uttar Pradesh Cooperative Societies (Amendment) Act, 2008.

|Statement of Objects and Reasons. - Section 20 of the Uttar Pradesh Cooperative Societies Act, 1965 inter alia provides for giving voting rights to a depositor who has maintained a deposit of at least rupees one thousand for a period of two years preceding the date fixed for publication of voter list. This provision is applicable to the members of all types of societies. This provision was made by amending the said Act by the Uttar Pradesh Cooperative Societies (Third Amendment) Act, 2007 on the basis of Memorandum of Understanding signed between the Government of India, National Bank for Agriculture and Rural Development and the State Government. According to the provisions of the said memorandum, the said provision should be applicable only to the members of Primary Cooperative Credit Societies. It has, therefore, been decided to amend the said Act of 1965 for the said purpose. Sub-section (7) of Section 29 of the said Act provides that the administrator of a cooperative society shall arrange for the reconstitution of the Committee of Management as soon as but not later than the expiry of six months. Since this period is to expire on March 5, 2008 and due to litigations it has not been possible to reconstitute the Committee of Management on or before March 5, 2008. It has, therefore, been decided further to amend the said Act of 1965 to extend the said period from six months to one year and six months. The Uttar Pradesh Cooperative Societies (Amendment) Bill, 2008 is introduced accordingly.|
