Notification No. For 25/52, dated the 21st April, 1959. - In exercise of the powers conferred by sub-section (1) of Section 34 of the Assam Forest Regulations, 1891 (7 of 1891) read with Clause (h) of sub-section (2) thereof, the Governor of Assam is pleased to make the following rules :

1. Short title, extent and commencement. - (1) These rules may be called the North-East Frontier Agency (Royalty on Forest Produce) Rules, 1958.

(2) These rules shall apply to the whole of the North-East Frontier Agency and shall come into force with immediate effect.

2. Royalty leviable on forest produce. - Royalty shall be levied on all classes of forest produce removed from any land at the disposal of them at the rates prescribed in the Schedule annexed hereto.

Schedule

I. Royalty on timber

1. Royalty on logs per cubic foot:

In Classes A-I and A-II, the classification of logs for royalty assessment will be made on measurement at 4 ½' from the largest end but in all other classes the classification will be based on midgrith measurement. The cubic contents of logs will be calculated by multiplying the square of the quarter girth taken in the middle of the log by the length of the log.

2. The above rates for girth measurements are taken over bark. For measurements taken under bark add. Rs. 0.50 per cent, to each rate. For all dressed poles and logs and 20 per cent to the above rates.

3. Rates for sawn timber will be double the above rates applicable to logs having a girth of 4' 6" and over, irrespective of the girth of logs from which the swan the timber has been converted.

4. Payment at log rates will enable the purchase to remove slabs obtained on conversion without further payment. Payment on sawn timber rates in the forests will not enable the purchaser to remove slabs obtained on conversion and these will be sold at rates which are fixed below under Clause 10.

8. Firewood is defined as wood under 6 feet in length unsuitable owing to hollowness, crookedness or other defects for conversion into scantlings and suitable only for use as fuel.

21. Increase and decrease of any of the rates is vested in the Director of Forests to a limit of 25 per cent of decrease and 25 per cent increase according to distance and difficulties of extraction.

22. All other minor forest produce not listed above will be charged royalty at 12 per cent ad volorem of decrease and 25 per cent increase according to distance and difficulties of extraction.

23. Ad valorem rates for all item mentioned in item 22 above will be issued on the 1st April each year from the office of the Director of Forests, North East Frontier Agency.
