Passports (1st Amendment) Rules, 2018

First published after having received the assent of the Governor on 10-3-2017 and published in the "Gujarat Government Gazette", Extraordinary Part IV, Extra No. 5, dated 14.3.2017.

1. Short title and commencement. - (i) These Rules may be called the Passports (1st Amendment) Rules, 2018.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. In the Passports Rules, 1980, in Schedule III, under "Section IV-Documents to be Attached with The Application" for Paragraph (C) the following shall be substituted, namely :

"(C) Out of Turn Issue of Passport under tatkaal Scheme :

(a) If an applicant of the age of 18 years and above desires to obtain a passport under the Tatkaal Scheme, the applicant in addition to the Aadhaar Card/letter/e-Aadhaar containing the 12 digit. Aadhaar number/28 digit Aadhaar Enrolment I.D. printed on the Aadhaar Enrolment Slip issued by the Unique Identification Authority of India (U.I.D.A.I.), a self-declaration prescribed in Annexure-E of the Passport Rules, 1980, and the prescribed Tatkaal fee, shall submit any two of the following documents, namely :

    (i) Electors Photo Identify Card (E.P.I.C.)

    (ii) Service Photo Identity Card issued by State/Central Government, Pulic Sector Undertakings, Local bodies or Public Limited Companies.

    (iii) Scheduled Caste/Scheduled Tribe/Other Backward Class Certificate.

    (iv) Arms Licence.

    (v) Pension Document such as Ex-servicement’s Pension Book/ Pension Payment order, Ex-servicemen’s widow/dependent Certificate, Old Age Pension Order.

    (vi) Self-Passport (unrevoked and undamaged).

    (vii) Permanent Account Number (P.A.N) Card.

    (viii) Bank/Kisan/Post Office Passbook.

    (ix) Student Photo Identity Card issued by an Educational Institution;

    (x) Driving Licence (valid and within the jurisdiction of State of submission of applicant).

    (xi) Birth Certificate issued under the Registration of Births and Deaths Act; and

    (xii) Ration Card;

(b) If a passport under the Tatkaal Scheme is required for a person below 18 years, the applicant in addition to the Aadhaar Card/letter/ e-Aadhaar containing the 12 digit Aadhaar number/28 digit Aadhaar Enrolment I.D. printed on the Aadhaar Enrolment Slip, and the prescribed Tatkaal fee, shall submit any one out of the following documents, namely :

    (i) Student Photo Identity Card issued by an Educational Institution;

    (ii) Birth Certificate issued under the Registration of Births and Deaths Act; and

    (iii) Ration Card;

(c) All applicants seeking a passport out of turn under the Tatkaal Scheme are advised to submit their applications, documents and fee as prescribed;

(d) No proof of urgency is required for out of turn issue of passport under Tatkaal Scheme;

(e) Post Police Vertification shall be done in all the cases of issue of passport under Tatkaal Scheme.

(f) In all the cases of Tatkaal scheme where the applicant is paying an additional Tatkaal fee, the passport, subject to the satisfaction of the Passport Authority, shall preferably be issued within a period of three working days from the date of submission of application.

3. In the Passport Rules, 1980, in Schedule III, after Paragraph (C), the following Paragraph shall be inserted, namely :

"(D) Out of Turn Issue of Fresh Passport under normal Scheme Without Paying any Additional Tatkaal Fee.

(a) If an applicant of the age of 18 years and above applies for a new passport under the Normal scheme and desires to obtain the passport on out of turn basis without paying the additional Tatkaal fees, he shall submit in addition to the Aadhaar Card/letter/e-Aadhaar containing the 12 digit Aadhaar number/28 digit Aadhaar Enrolment; I.D. printed on the Aadhaar Enrolment Slip issued by the Unique Identification Authority of India (U.I.D. A.I.), and a self-declaration prescribed in Annexure-E of the Passport Rules, 1980, any two of the following documents, namely :

    (i) Electors Photo Identify Card (E.P.I.C.)

    (ii) Service Photo Identity Card issued by State or Central Government, Public Sector Undertakings, Local bodies or Public Limited Companies;

    (iii) Scheduled Caste/Scheduled Tribe/Other Backward Class Certificate;

    (iv) Arms Licence;

    (v) Pension Document such as Ex-servicemen’s Pension Book or Pension Payment order, Ex-servicemen’s widow or dependent Certificate, Old Age Pension Order;

    (vi) Self-Passport (unrevoked and undamaged);

    (vii) Permanent Account Number (P.A.N.) Card;

    (viii) Bank/Kisan/Post Office Passbook;

    (ix) Student Photo Identity Card issued by an Educational Institution;

    (x) Driving Licence (valid and within the jurisdiction of State of submission of applicant);

    (xi) Birth Certificate issued under the Registration of Births and Deaths Act; and

    (xii) Ration Card.

(b) If an applicant below the age of 18 years applies for a new passport under the Normal scheme and desires to obtain the passport on out of turn basis without paying the additional Tatkaal fees, he shall submit in addition to the Aadhaar Card/letter/e-Aadhaar containing die 12 digit Aadhaar number/28 digit Aadhaar Enrolment I.D. printed on the Aadhaar Enrolment Slip issued by the Unique Identification Authority of India (U.I.D.A.I.), any one of the following three documents, namely :

    (i) Student Photo Identity Card issued by an Educational Institution;

    (ii) Birth Certificate issued under the Registration of Births and Deaths Act; and

    (iii) Ration Card.

(c) Post Police Verification shall be done in all cases of issue of passport under this Scheme.

(d) There shall be no additional fee payable by the passport applicant to avail this Scheme.

(e) If such an applicant seeks to obtain passport under Tatkaal Scheme by payable the prescribed additional Tatkaal fee, the application shall be processed by the Passport Issuing Authority under the Tatkaal scheme as the applicants applying under the Tatkaal Scheme shall be given priority in getting appointments and in the printing of passports.".
