Statement of Objects and Reasons - "With a view to separate the interests of evacuees from those of non-evacuees in composite properties the Central Legislature enacted the Evacuee Interest (Separation) Act in 1951. This Act was made applicable to all States in the Union and the Central Legislature considered at the time that they were competent to enact this legislation on behalf of all the States who had all been asked to pass a resolution authorising the Parliament to put this law on the Statute Book. Some doubts had, however, been expressed about the validity of this procedure. Therefore, it is proposed to enact this Bill. By virtue of the resolution passed by Parliament in terms of Article 249 of the Constitution of India, the Central Legislature was competent to enact this legislation till the 14th December, 1952, and it is, therefore, necessary that the Supplementary Legislation should come into force from the 15th of December, 1952.
