Section 26 and Section 69, cls. second and third of Bombay Regulation 4 of 1827 were declared by the Laws Local Extent Act, 1874 (15 of 1874), Section 5, to be in force in the whole of the State of Bombay, except as regards the Scheduled Districts.
A Regulation prescribing the forms of proceeding of the Courts of Law in civil suits and appeals, and rules for the trial of the same.Preamble. - Repealed Act X of 1861, and again repealed by Act X of 1869.
1 to 25. Repealed, Act X of 1861 and XIV of 1869.26. Law to be observed by Court. - The law to be observed in the trial of suits shall be Acts of Parliament [of the United Kingdom] and [Indian laws] applicable to the case, in the absence of such Acts and [laws], the usage of the country in which the suit arose; if none such appears, the law of the defendant; and, in the absence of specific law and usage, justice, equity, and good conscience alone.
27 to 100. Repealed Acts X of 1861; XVII of 1862; XVI of 1869; VI of 1874; and 2nd and 3rd clauses of section 69 (locally), Bombay 5 of 1879.
