An Act to validate and supplement certain provisions of the Evacuee Interest (Separation) Act, 1951, in its application to the State of Bombay.
Whereas it is expedient to validate and supplement certain provisions of the Evacuee Interest (Separation) Act, 1951, in its application to the Stale of Bombay; It is hereby enacted as follows :-
1. Short title, extent and commencement. - (1) This Act may be called the Bombay Evacuee Interest (Separation) Validating and Supplementary Act, 1953.
(2) It extends to the whole of the State Bombay.
(3) It shall come into force at once.
2. Supplementing and validating of certain provisions of Act LXII of 1951. - (a) The provisions of the Evacuee Interest (Separation) Act, 1951, shall in so far as they relate to any of the matters enumerated in List II in the Seventh Schedule to the Constitution be deemed to be and always to have been valid and effectual for all purposes as if they had been in relation to any such matters as aforesaid enacted by the State Legislature with effect from the 15th day of December, 1952; and
(b) any order made or action taken by any competent authority or anything duly done under the said Act on and after the aforesaid date in so far as such order, action or thing relates to any such matters as aforesaid shall not be called in question on the ground that the order, action or thing is invalid and ineffectual by reason of the incompetence of Parliament to make laws relating to any of the aforesaid matters.
