The Mizoram Aided College Management Rules, 1988
Published vide Notification No. B 1011/4/1988-EDC, dated 8th November, 1988, published in the Mizoram Gazette, Extraordinary No. 17, dated 8-11-1988
(a) "Affiliating University" means a University to which a College in Mizoram is affiliated for the purpose of the various examinations conducted by the University ;
(b) "Committee" means the Governing Body of a College duly constituted and approved by the Government;
(c) "Department" means the department of Education and Human Resources Department;
(d) "Director" means the Director of Higher Education ;
(e) "Government" means the Government of Mizoram ;
(f) "Governor" means the governor of Mizoram ;
(g) "Grant" means recurring grant-in-aid for general maintenance of the institution and includes all financial assistance given on this account to an institution in cash and/or in kind ;
(h) "President" means the President of the Governing Body ;
(i) "Secretary" means the Secretary of the Committee ;
(j) "Treasure" means any one member of the Government Body declared to hold the office by a voted resolution of the committee.3. Management of Government Aided College. - Every Government Aided College shall be governed by a Governing Body the constitution of which has been approved by the Director of Higher Education, Mizoram save in case where the Secretary to the Government of Mizoram in Education Department allow as an exception under special circumstances. 4. Governing Body of the Aided College. - Save in cases where the Secretary to the Government of Mizoram in the Education Department sanction a special Body under special circumstances, each Governing Body shall consist of the following members namely :
(a) One President;
(b) One Secretary ;
(c) Three representatives of the teaching staff of whom the Principal of the College shall be one, other representatives to be elected annually by the teachers from among themselves ;
(d) Two representatives of the affiliating University to be nominated by the concerned University;
(e) Three persons (official or non-official) to be nominated by the Government of whom at least one should be an officer from the Directorate of Higher Education not below the rank of a Deputy Director.
(f) Two local persons other than the members of the teaching staff to be nominated by the Director of Higher Education on the recommendation of the Principal, one of whom shall be a guardian and other a lady :
(g) Donor's nominee. - Donor who paid Rs. 25,000 or more to the College fund or his/her nominee would continue to be the member. For new donors, representation will be limited to one to be elected by new donors from among themselves in every two years.5. Functions of the Governing Body. - (1) The President of Governing body shall be nominated by the Government and he shall be ex-officio member of the Governing Body. (2) The Secretary of the Governing body shall be nominated by the Government and if the Principal is not so nominated Secretary to the Governing Body, he shall be appointed the Joint Secretary. (3) The tenure of the Governing Body shall be ordinarily for two years from the date of formation. The Government may extend the term by pending reconstitution of the Governing Body. (4) The Governing Body shall meet at least once in three months. (5) Six members present shall form a quorum. (6) The proceedings of the Governing Body meeting shall be sent to the Director of Higher Education and the North Eastern Hill University, and no final decision regarding any action involving expenditure for which grant from the Government are solicited by the College shall be taken without prior approval of the Director of Higher Education, Mizoram. (7) No act or proceeding of the Governing Body shall be invalidated merely by reason of any vacancy in its membership. (8) On the recommendation of the Director of Higher Education, the Government may, if satisfied after due notice and enquiry, order reconstitution of the Governing Body. (9) The Governing Body shall undertake the financial management of the College, the collection of authorised subscription for the College and the realisation of fees at the rate approved by the government. (10) (a) The Secretary shall work on behalf of the Governing Body and shall receive grants and allotments of fund from the Department as and when made, maintain full accounts together with supporting vouchers of any expenditure made therefrom with the approval of Governing Body, and submit utilisation certificates along with the statement of accounts to the authority from whom the grants of allotments are received promptly within the period stipulated by the authority.
(b) Separate accounts should be opened for Grants-in-aid and grant allotments received from Government/department by maintaining proper accounts of receipts and expenditures.(11) It shall be the duty of the Secretary to ensure that all utilisation certificate and statements of the accounts furnished by him in respect of any grant allotment are duly signed by him and the President of the Governing Body as a token of their authenticity. (12) There shall be a treasurer to be selected amongst the members other than the teacher-members, in the first sitting of the Governing body. (13) It shall be the duty of the Treasurer to open a joint bank account in the name of the Secretary and the Treasurer of the Governing Body where all the College fund will be deposited. He shall maintain proper account of the College fund and assist the Secretary in his duties as given under Clauses (10) and (11) above. (14) The Governing Body shall be responsible for the maintenance of the College buildings, furniture and equipments and to arrange for annual internal audit of all college funds and verification of stock and furniture. These duties may be entrusted to two members of the Governing Body, other than the office bearers and teacher-members. if there is no such member in the Governing Body, other than the Governing Body competent to take up these duties, it may employ outsiders for the purpose on reasonable payment, if its funds permit. (15) The other duties and functions of the Governing Body shall be-
(a) to determine the general scheme of studies and faculties for the College subject to approval by the University and to obtain the approval of the Government through the Director of Higher Education with regard to the inclusion or opening of additional subjects/faculties, creation of new posts and opening of new shifts ;
(b) to consider the initiate to projects for the improvement of the college ;
(c) to deal with questions of grant of leave to the teachers and other staff, and matters of discipline, subject to prescribed rules, the grant of leave other than casual leave and arrangement made to fill the vacancy should be reported to the Director of Higher Education for due approval;
(d) to deal with any question and exercise any function that may be referred to or assigned by the Government or the University.(16) The Secretary of the Governing Body shall submit annual report to the Director of Higher Education with a copy to the Secretary, Education and Human Resources Department, Government of Mizoram, on the general conditions and progress of the College as per proforma prescribed by the Rules governing the maintenance grant to Aided Colleges in Mizoram. (17) The Government shall have power to readjust membership of Governing bodies of institution to bring the same in conformity with the requirements of the affiliating University in consultation with the authorities concerned. (18) A building committee shall be constituted from among the Governing Body members, consisting of at least four members of which two shall be drawn from the teaching staff. Whenever there is scheme for construction of any building, the Committee shall be responsible for all matter relating to college building construction and see that the term of the Committee shall be normally two years and which may be extended by one year. 6. Repeal and saving. - (1) The Mizoram Aided College Management Rules, 1975 shall stand repeated with effect from the date these rules come into force. (2) Notwithstanding such repeal, any action taken or to be taken or purported to have been taken under the rules to repealed shall be deemed to be taken or purported to have been taken under these rules.
