Notification No. 14847, dated 25th August, 1967. - In exercise of the powers conferred by Sub-section (1) of Section 11 of the Orissa Express Highway Act. 1964 (Orissa Act 8 of 1964), the State Government do hereby make the following rules the same having been previously published as required by the said section of the said Act, namely:

Chapter-I

General

1. Short title, extent and commencement. - (i) These rules may be called "the Orissa Express Highway Rules, 1967".

(ii) They extend to the whole of the State of Orissa.

(iii) They shall come into force on such date as the State Government may, by notification, appoint.

2. Definitions. - In these rules, unless the context otherwise requires-

(a) "Act" means the Orissa Express Highway Act, 1964 (Orissa Act 8 of 1964);

(b) "articulated vehicle" means a tractor to which a trailer is attached in such manner that part of the trailer is superimposed on any part of the weight of the trailer is borne by the tractor;

(c) "fee" means the amount charged for issue of permit under Section 5;

(d) "Form" means a form appended to these rules;

(e) "Government" means the Government of the State of Orissa;

(f) "permit" means a permit issued under Rule 5;

[(g) "prescribed authority" means the Chief Engineer, Roads and Buildings, Orissa, the Chief Engineer (Projects), Orissa, or such other person or persons, as may be authorised by the State Government from time to time for the purpose of the Rules 3 to 9 of the Orissa Express Highway Rules, 1967;]

(h) "Section" means a section of the Act;

(i) "State" means the State of Orissa;

(j) "Toll" means toll which is levied under Section 6 for the actual user of any express highway;

(k) "Toll Collector" is a person appointed as such for the purposes of Section 6;

(l) "Toll gate" means a lace specified as such by notification where toll may be collected;

(m) other words and expressions which are used but not defined herein shall have the same meaning respectively assigned to them in the Act and the Motor Vehicles Act, 1939 (IV of 1939).

Chapter-II

Permit

3. Permits for using any express highway. - [(a)] No vehicle [* * *] shall use express highway except under, and in accordance with, the terms and conditions of a permit issued under these rules :

Provided that no permit shall be required for a [* * *] domestic animal, bullock cart, cycle, tricycles vehicle and the like crossing the express highway at the crossings thereon approved by the prescribed authority according to the proviso to Sub-section (1) of Section 6.

[(b) Pedestrians shall use only the flanks of the express highway and no permit is necessary for the said purpose as well as for their crossing the express highway at the crossings mentioned in the proviso to Sub-rule (a).]

4. Form of application for permit. - Every application for a permit for the use of any express highway shall be made to the prescribed authority

(i) [* * *]

(ii) in Form 2 when the use is to be by a goods vehicle;

(iii) in Form 3 when the use is to be by any vehicle other than a goods vehicle.

5. Authority to grant or renew permit. - (a) The prescribed authority shall take into consideration the matters specified in Section 5 and may either grant or refuse to grant a permit as it deems proper.

(b) The permits to be granted by the prescribed authority shall be in-

(i) [* * *]

(ii) Form 5 for a goods vehicle;

(iii) Form 6 for a vehicle other than a goods vehicle.

6. Fees for permit. - (a) The fees in respect of grant or renewal of permits other than the temporary ones shall be Rs. 60 per goods vehicle and passenger bus. And the fees for grant or renewal of permits for a vehicle other than a goods vehicle and passenger bus shall be Rs. 36. This permit will be valid for one year from the date of grant of the same.

(b) The fee for temporary permit in respect of a vehicle shall Rs. 2 for the first day and that for more than one day but not exceeding ten days Rs. 7.

7. Renewal of permits. - Application for the renewal of a permit shall be made in writing to the prescribed authority not less than one month before the expiry of the permit. The application shall state the period for which the renewal is sought and shall be accompanied by the fee prescribed for it.

8. Cancellation, suspension or expiry of permits. - (a) The permit holder may at any time surrender the permit to the prescribed authority who shall forthwith cancel the permit so surrendered.

(b) When the prescribed authority suspends or cancels any permit, the permit-holder shall surrender the permit within seven days of receipt of a demand in writing by the prescribed authority,

9. Collection of fees. - (a) Receipt books containing receipts with counterfoils in Form 7 shall be kept in the office of the prescribed authority. The receipt books will be serially machine numbered. The person paying the fee shall be entitled to a receipt therefor. The amount of fee shall be entered in the counterfoil also.

(b) Regarding collection of fees the prescribed authority shall cause to be entered the number of receipts (as prescribed in Form 7) issued in a day serially in a bound register in Form 8.

(c) The prescribed authority shall superintend and be responsible for collection, crediting and accounting of fees.

(d) No fees shall be required to be paid for permits in respect of vehicles-

(i) mentioned in Section 6 (4);

(ii) of the Police Force when Police is required for enforcement of the provisions of the Act or the rules thereunder;

(iii) of the Public Works Department when used by officers of the said Department in connection with the express highway;

(iv) of the Governor, the Chief Minister, the Ministers, the Deputy Ministers, or any Government servant of the Government or of the Union Government;

(v) of any other person permitted by the State Government.

10. Prohibitions and restrictions. - (i) No person shall encroach upon or occupy any portion of the express highway.

(ii) No vehicle shall ply on the express highway at a speed of more than 80 kilometers per hour.

(iii) No vehicle having axle load exceeding 20 tonnes shall ply on the express highway.

(iv) Processions or conducting of animals along the express highway are prohibited.

11. Removal of obstruction. - (a) When as a, result of check of any express highway boundaries or otherwise it transpires that an encroachment has taken place on any express highway, the prescribed authority shall serve a notice in Form 9 on the person responsible for the encroachment, or his representative, requiring him to remove such encroachment and restore the land to its original condition before the encroachment within the period specified in the notice.

(b) The notice shall specify the land encroached upon, the time limit within which such encroachment shall be removed, and shall also state that failure to comply within the specified period shall render the person liable to prosecution and also to summary eviction.

(c) If the encroachment is not removed within the time-limit specified in the notice and no valid cause is shown for non-compliance, the prescribed authority may prosecute such person for his having made or caused the encroachment and for his failure to remove it within the specified time.

(d) Where the encroachment is made for the purpose of exposing articles for sale, opening temporary booths for vending or other like purposes of trivial nature, the prescribed authority may, with the help of the police, if necessary, have such encroachment summarily removed without issuing a notice as required by Sub-rule (a).

(e) When the encroachment is of a temporary nature and can easily be removed, but is not such as can be described as trivial within the meaning of Sub-rule (d), the prescribed authority may, in addition to or in lieu of prosecuting the person responsible for the encroachment under Sub-rule (c) have the encroachment summarily removed with the assistance of the police, if necessary.

(f) Where the encroachment is of such a nature that its immediate removal is considered essential in the interest of safety of traffic on the express highway or the safety of any structure forming part of the express highway, the prescribed authority may in addition to the prosecution of the person under Sub-rule (c), either -

(i) construct at reasonable cost such protective work, as may be feasible, so as to minimise the danger to traffic on the express highway; or

(ii) have the encroachment removed with the help of the police, if necessary.

Chapter-III

Toll

12. Appointment of an officer to superintend the collection of toll. - (i) The prescribed authority shall superintend and be responsible for the collection, crediting and accounting of tolls.

(ii) No vehicle except those mentioned in Sub-section (4) of Section 6 shall cross the toll gate without paying the toll at the rate declared by Government.

(iii) The prescribed authority shall have power to appoint non-gazetted officers for collection of tolls and control the offices of such officer or officers with a view to see that tolls are properly collected, accounts are properly maintained and collections are properly credited in the manner laid down hereinafter.

(iv) The prescribed authority shall specify by a notification the place or places where toll gates should be established with the prior approval of Government.

13. Appointment of toll collectors. - In addition to the powers and duties provided in the Act, toil collector shall have the following powers and duties-:

(i) He shall exhibit in a conspicuous place near the toll gate a table of the rates at which toll has been authorised to be levied. The table shall be legibly written or printed in English and Oriya. A statement of penalties for non-payment of the tolls and for taking any unlawful tolls shall also be written and exhibited in like manner.

(ii) He shall not leave the toll gate at any time without prior permission of the prescribed authority.

(iii) He shall be responsible for proper collection of tolls and maintenance of accounts in the Forms I and II respectively. Form 10 shall be in duplicate one of which shall be carbon copy.

(iv) He shalt at no time keep with himself more than Rs. 100 collected as tolls.

(v) He shall regulate the credit and collections in the manner provided in rule.

14. Collection of toll. - (i) Toll shall be collected at such rate as may be declared by the Government front time to time by notification.

(ii) Receipt books containing receipts with counterfoils in Form 10 will be kept in the toll gate. The receipt books will be serially machine numbered. When the toll collector on duty has collected the toll, he shall hand over receipt or receipts to the person paying the toll and shall at the same time, enter the amount received in the counterfoil.

15. Accounting procedure. - (a) Regarding collection of tolls the toll collector shall enter the number of receipts (as prescribed in Form 10) issued by him in a day serially in a bound register set out in Form 11.

(b) When one toll collector is relieved by another at the end of his period of duty the number of tickets left in each receipt book and the amount realised by issue of tickets shall be checked and the register initialled by the relieving toll collector in token of the correctness of the tickets and the cash received.

(c) The amount realised each day shall be kept in a safe embedded in the toil gate and remitted to the Sectional Officer-in-charge of the section or the Sub-divisional Officer-in-charge of the maintenance subdivision on the following day with a challan in the Form 12, one copy of which will be retained by the officer receiving the amount and the other returned to the toll collector. When the toll gate is situated away from the headquarters of the sub-division, the amount realised as toll shall be remitted on the following day to the Sectional Officer, who shall remit it to the Sub-divisional Officer or credit it to the nearest treasury as may be directed by the Sub-divisional Officer.

(d) The cash in the chest and the register shall be checked by the Sub-divisional Officer whenever he visits the toll gate and he shall record the result of his check in the register.

(e) The Sub-divisional Officer shall maintain the following registers:

(i) A register showing the number of receipt books received by him and issued to the toll collectors from time to time.

Note - An acknowledgement should be taken by the Sub-divisional Officer from the toll collector for the receipt books issued to them.

(ii) A register showing the amount of toll collected daily and each month.

(f) Each toll collector shall furnish a security deposit of Rs. 100 in cash and a personal security for, the some amount. Any loss to Government on account of short realisation on the total value of receipts issued to a toll collector shall be recovered from his security deposit.

[Chapter-IV]

Compounding of toll

16. The toll payable by an owner in respect of the goods or vehicles under Sub. - section (1) of Section 6 may be compounded by the prescribed authority on receipt of an application from owner of any such goods or vehicles in From No. 13.

17. The prescribed authority shall superintend and be responsible for compounding the toll, its collection in advance, crediting and accounting the same.

18. The compounding of toll of a particular applicant shall be done on a specific quantity fixed by the prescribed authority on the basis of quantity transported as certified by the Director of Mines, Orissa, during the quarter preceding the date of application.

19. The application for compounding of toll shall be accompanied with a certificate of the quantity transported from the Director of Mines, Orissa for the quarter preceding the date of application. Fees for the application form for compounding of toll will be 20 paise each. All such applications should be made through the Executive Engineer concerned during office hours on working days.

20. The compounding of toll on the above basis shall be made once in a quarter. The application for such compounding of toll shall be made one month in advance of the commencement of the next quarter. The first quarter will begin from the 1st January, the second quarter from the 1st April of every year and so on.

21. On receipt of the application in the prescribed form, the prescribed authority shall scrutinise the same and may accept or reject the same, if not in order.

22. Before permitting compounding of toll the prescribed authority may verify the total weight mentioned in the application and the quantity certified by the Director of Mines, Orissa during the period from the records in Paradeep Port Trust Office and from the weighbridge records at Paradeep and Banaspani Railway Stations.

23. The prescribed authority after permitting the compounding of the toll shall return the applications duly filled and signed (in ink) and stamped with official stamp to the officer-in-charge of advance collection.

24. The prescribed authority shall specify by a notification the place or places and the Executive Engineer, by whom the advance collection of toll will be done with prior approval of Government.

25. Toll shall be compounded and collected in advance for express highway Nos. land 2 at the rates and manner indicated below :

    (a)

    Express Highway No. I from Zero Point at Daitari Mines to the points where it crosses the National Highway No. I near Haridaspur

    Loaded truck

    Leviable per tonne on the actual weight tonne carried by each of the vehicles as furnished by the Director of Mines, Orissa

    Rs. 3.00 per tonne

    (b)

    Express Highway No. 2 from Zero point near Bambari to its termination point near Banaspanai Railway Station

26. The deposit for compounding of toll shall be made by the party in any Government treasury of the State of Orissa and the original copy of the challan produced before the concerned Executive Engineer. The challan for such deposit shall be got countersigned by the prescribed authority and it will-be preserved in the office of the Executive Engineer concerned after noting the treasury challan number.

27. The receipt books containing equal number of receipts in Form No. 14 in duplicate shall be printed by the prescribed authority and issued to the Executive Engineer from time to time. The receipt books and the receipts therein shall be machine numbered. The printed receipt books shall be preserved in the Office of the Executive Engineer concerned. The Executive Engineer shall maintain a register showing the number of receipt books received by him from the prescribed authority and used in compounding toll from time to time.

28. After ensuring the deposition of compounded toll in the treasury, the Executive Engineer shall hand over the receipt or receipts to the persons who have made payment in Form No. 14 and retain the duplicate carbon copy in the receipt book.

29. The Executive Engineer in charge of toll collection shall be responsible for proper collection compounded toll in advance and maintenance of accounts.

30. The Executive Engineer in charge of collection of compounded toll shall enter the number of receipts issued by him in a day serially in a bound register set in Form No. 15.

31. After ensuring the deposition of compounded toll in the treasury, the Executive Engineer shall issue a pass and a token to each of the vehicles which the applicant intends to engage, in Form Nos. 16 and 18 one week before the commencement of the quarter of which toll has been paid.

32. The passes and the token after duly filled shall be signed by the concerned Executive Engineer stamped by official stamp before issue to the party concerned.

33. The Executive Engineer shall enter the number of passes and tokens issued by him serially in bound register set out in Form No. 17 and obtain the signature of the recipient in the register.

34. The registration number of the vehicles for which passes and tokens have been issued and the period for which such passes and token have been issued should be intimated to all the toll gates and check-gates with instructions not to collect toll from those vehicles for the period and to allow them to proceed after checking the passes and the goods permitted to be carried

35. The tokens thus issued shall be depicted on the vehicle (in respect of which advance payment has been made) in a conspicuous manner and the passes shall be carried in the vehicle.

36. The loaded vehicles with the permitted goods to be carried and in the possession of valid passes shall be allowed to pass at the toll gates without demanding toll.

37. The empty vehicles in possession of valid passes will also be allowed to pass at the toll gates without demanding toll.

38. Toll at the toll gates should be charged at the usual rate prescribed under Sub-section (1) of Section 6 of the Express Highway Act, 1964 from the vehicles which do not possess a valid pass.

39. Used receipt books shall be preserved in the office of the Executive Engineer and may be destroyed three years after the date of auditing the same.

40. The Superintending Engineer shall check the accounts in the office of the advance collections quarterly and record the results of check in the register maintained in Form No. 15. After check he should furnish a report to the prescribed authority and to Government within a week with the remarks that the records and amount collected is chocked by kim and found correct.

41. A quarterly progress report of the amount collected in advance shall be furnished to Government by the prescribed authority at the end of every quarter.

42. Immediately after expiry of every quarter the Executive Engineer shall find out the total quantity of ore transported and the difference of collection of toll has either to be adjusted towards payment of compounded toll in subsequent quarters or realised from the party as the caw. may be. The account has to be maintained in Form No. 19.

[Chapter-IV-A]

Assessment and levy of toll on Express Highway No. II

42A. The Director of Mines, Orissa shall superintend and to be responsible for assessment and collection of toll on Express Highway No. II

42B. Any person, company or corporation desiring to transport mineral ores Dy vehicles on Express Highway No. II shall apply to the Senior Mining Officer, Joda for permission in Form No. 2.

42C. The Senior Mining Officer, Joda shall, subject to the provisions contained in Rule 5, accord permission to the person, company or the corporation, as the case may be, in Form 5 on receipt of the application in Form No. 2.

42D. The weight of minerals/ores shall be recorded each time on the basis of records of weighbridge installed/recognised by the Director of Mines on or near the Express Highway No. II. The accounts shall be maintained in Form No. 20.

42E. (1) The person, company or the corporation, as the case may be, shall deposit the toll charges in a Government treasury under the Head "Demand No. 7/137-Roads and Bridges-(a) Tolls on Roads (B) Express Highway No. II Works Department" on the basis of the weighbridge records within 15th of the month following. The Senior Mining Officer, Joda shall assess the toll amount at the rate prescribed by the Government at the end of every quarter and issue demand notice of different toll remaining unpaid, if any, in Form No. 21.

(2) The Senior Mining Officer, Joda shall furnish monthly progress report of collection of tolls to Works Department, Chief Engineer, Roads, Superintending Engineer, Roads and Building Circle, Keonjhar and the Director of Mines regularly.

42F. After depositing the toll amount the person, company or the corporation, as the case may be, shall terminate the fact of such deposit to the Sailor Mining Officer, Joda in Form No. 22 and obtain receipt of acknowledgement therefor from him in Form No. 23. If the dues are not paid within ton days from the date of issue ai demand notice, the transporter shall be liable to pay interest at the rate of ten per cent per annum on the arrears from the due date of payment.

42G. Part payment against the dues by the person, company or corporation shall not be allowed without the approval of Government.

42H. The used receipt books and demand notice, etc. shall be preserved in the office of the Senior Mining Officer, Joda and may be destroyed after three years of the date of its audit. The approval of Government shall be obtained before such destruction.

42I. The provisions of this Chapter shall in relation to matters which are provided for herein have effect anything to the contrary contained in any other provision of these rules notwithstanding.

[Chapter-VI]

Miscellaneous

43. Penalty for damages to the express highway. - (i) No person shall cause or allow any vehicle or animal in his charge to cause any damage to any express highway.

(ii) Where in contravention of Sub-rule (i) any damage has been caused to any express highway the prescribed authority shall have the damage reported and expenses involved shall, without prejudice to any other action that may be taken against the person responsible for the contravention of Su6-rule (i), be claimed to be recovered from him under Section 8.
