The Orissa Forest Shooting Rules, 1973

Notification No. S.R.O. 883/73, dated 15th October, 1973. - In exercise of the powers conferred by Section 82 read with Sections 27(3)(b) and 36(j) of the Orissa Forest Act, 1972 (Orissa Act 14 of 1972) the State Government do hereby make the following rules to control and regulate hunting, shooting, fishing, poisoning water, setting traps or snares and collection of wild life in the reserve and protected forests, namely :

1. Short title, extent and commencement. - (a) These rules may be called the Orissa Forest Shooting Rules, 1973.

(b) These rules shall apply to all reserve and protected forests.

(c) These rules shall come into force with effect from the date of their publication in the Orissa Gazette.

2. Definition. - In these rules unless there is anything repugnant in the subject or context-

(a) "Act" means the Orissa Forest Act, 1972;

(b) "Big game" means any wild animal specified in Schedule I;

(c) "Closed season" shall, subject to the period specified in this behalf in Schedule III for animals mentioned therein ordinarily mean the period from 1st May to 31st October of any year;

(d) "Form" means a Form appended to these rules;

(e) "Government" means the Government of Orissa;

(f) "Hunt" means to hunt, kill, or capture any wild animal by any method and includes every attempt to kill or capture it or to take or destroy any part of its body or egg or nest or to disturb its egg or nest;

(g) "Park" means National Park or a State Park declared as such;

(h) "Permit" means a permit granted under these rules;

(i) "Pest" or "vermin" means any wild animal specified in Schedule II

(j) "Protected species" means animals and birds which have been declared as such under the Wild Birds and Animals Protection Act, 1912 (Act VIII of 1912)

(k) "Schedule" means Schedule appended to these rules ,

(l) "Tools" include fire arms, ammunition, torches, spot lights or any other artificial light which can be manipulated to dazzle wild animals khukri, knives, spears, bows, arrows, poisons, anaesthetic or any instrument used to kill or injure or anaesthetise wild animals;

(m) "Trophy" means the durable part of wild animal which has been preserved by any means, whether natural or artificial, and includes the head or horn, tooth, tusk, bone, claw, hoof, skin, hair, feather, egg or nest but dues not include any article manufactured from any such part of the animals;

(n) "Vehicle" means any mechanically or otherwise propelled vehicle and includes boats, rafts and animals used for transport;

(o) "Wild animal" means animal found in the Wild State in the Forests and includes birds and reptiles as also the flesh, blood, fat, horn, skin, bone, tusk, eggs, feather and any other part of such animals, birds and reptiles;

(p) "Wild Life Conservation Officer" means any officer appointed by the Government to be in charge of Wild Life Conservation Division.

3. National Park and Sanctuaries. - (1) The State Government may, by notification in the Official Gazette, declare any reserve or protected forest or part thereof a "National Park" on the advice of the Indian Board for Wild Life or a "State Park" on the advice of the State Board for Wild Life to be closed to any interference to flora and fauna.

(2) (i) The Chief Conservator of Forests may, by notification in the Official Gazette, declare any reserved forest or a portion.thereof as sanctuary to be altogether closed to hunting for any period. If, however, any portion of protected forest is proposed to be included in a sanctuary, such notification shall be issued by the Government.

(ii) The Chief Conservator of Forests, may, by notification in the Official Gazette, constitute any area within a sanctuary, as sanctum area.

4. (1) The working of the forests for extraction of forest produce from sanctuaries may be permitted by the Divisional Forest Officer, but grazing cultivation or habitation therein shall not be allowed except under the order of the Conservator of Forests.

(2) No working of the forests for extraction of forest produce from the sanction area and no grazing, cultivation or habitation therein shall be allowed except with the permission of the Chief Conservator of Forests.

(3) No working of the forests for extraction of forest produce from a park and no grazing cultivation or habitation therein shall be allowed except with the permission of the Government.

(4) No person shall enter into any park or sanctum area without a permit from the Divisional Forest Officer or from any officer authorised by him.

(5) The Divisional Forest Officer may establish check-gates on all public roads passing through any park, sanctuaries or sanctum area.

(6) No new roads or paths shall be made in any sanctuary or sanctum area except with the permission of the Conservator of the Forests. Construction of such roads or paths in parks shall require the approval of the Conservator of Forests.

(7) Any person entering a park or sanctuary through any check-gate shall declare whether he has with him any too.

(8) All vehicles coming out of a park or sanctuary or sanctum area shall be subject to thorough check at the check-gates.

5. Acts prohibited in forest. - The following acts are prohibited within a reserve or protected forest except when specifically permitted under a permit granted by the competent authority, namely :

(i) use of poison or dynamite to kill or capture wild animals or fish;

(ii) spearing or running with dogs any kind of deer or antelope;

(iii) shooting by sitting or watching in the neighbourhood of water or salt licks, any wild animal other than carnivore, bear and such other animals specially declared as dangerous and water birds;

(iv) erecting dams, weirs or fixing traps, diverting streams for the purpose of catching fish or driving fish ;

(v) shooting - (a) bison, elephant, buffalo with any weapon other than rifle of a bore equal to or larger than 400 or 376 magnum;

(b) any big game except with a rifle of a bore of 300 and above or with a bullet from a shot gun;

(vi) shooting or chasing from a wheeled vehicle or shooting from within 50 metres of such a vehicle or shooting between the hours of sunset and sunrise or with the aid of electric light, any animal other than carnivore or animal specially declared as dangerous;

(vii) shooting any protected species

(viii) hunting or shooting in any park or sanctuary;

(ix) killing or catching wild elephants in contravention of any rules made under the Elephants Preservation Act, 1879 (Act VI of 1879) or the Madras Wild Elephants Preservation Act, 1873 (Madras Act I of 1873);

(x) shooting the female or young of any kind of deer, antelope and bison;

(xi) shooting deer with horns in velvet;

(xii) shooting any wild animal within 500 metres from the premises of any sacred or religious place;

(xiii) retrieving, flushing or beating of wild animal by whatsoever means from a shooting block to any other area for the purpose of shooting or killing;

(xiv) The setting of nets, snares or pitfalls for catching any wild animals and the destroying or taking the eggs or nests;

(xv) hunting except by a person authorised under these rules for the destruction of such wild animals which are pest or vermin in a forest other than reserved forest;

(xvi) leaving any 'Machan' constructed or pit dug after it has served its purpose and in no case shall it be maintained in position for a period exceeding 48 hours;

(xvii) hunting or shooting any game during the close season.

6. Shooting blocks. - (1) Subject to the control of Conservator or Forests, the Divisional Forest Officer in consultation with Wild Life Conservation Officer, may divide the reserve or protected forests under his charge other than parks and sanctuaries into shooting blocks and when so doing shall fix before September in each year the limit of wild animals of each species which may be allowed to be killed in each shooting block during the next shooting season and shall restrict the killing so as to prevent such number being exceeded.

(2) The Conservator of Forests may, in consultation with the Wild Life Conservation Officer, close any shooting block where he considers the number of animals has gone down due to over killing or to any other reason.

7. Issue of permit by Divisional Forest Office. - Subject to the control of the Conservator of Forests, the Divisional Forest Officer may grant to any person or party-

(a) a permit in Form 'A' to hunt, shoot and fish;

(b) a free permit in Form 'B' for the destruction of any pest or vermin in a reserved forest.

8. Issue of permit by the Collector. - Subject to the control of Revenue Divisional Commissioner, the Collector of a District may consult the Divisional Forest Officer and grant to any person a free permit in Form '8' for the destruction of any animals declared by him to be specifically dangerous and on granting such a permit shall immediately inform the Divisional Forest Officer concerned and the Wild Life Conservation Officer.

Explanation - 1. The free permit issued under these rules shall not entitle the holder to take the animal or the trophy free of royalty, unless specifically permitted.

2. In case of urgent necessity the Collector may issue a free permit under intimation to the Divisional Forest Officer and the Wild Life Conservation Officer.

9. Issue of permit by Chief Conservator of Forests. - The Chief Conservator of Forests may grant a free permit in Form 'C' on such conditions as he may deem fit to impose which shall entitle the, holder to hunt wild animal irrespective of age or sex specified therein, in any area including a park or sanctuary for any of the following purposes :

(i) scientific research;

(ii) collection of specimens for zoological gardens, museums and similar institutions;

(iii) killing of such animals as are a source of serious menace to human life or property;

(iv) for better preservation of other wild animals and for control of population :

Provided that such permission in a park shall not be given without the approval of the Government.

10. Procedure for issue of permit. - (1) (i) Applications shall be made in writing to the Divisional Forest Officer with a proof of a valid arms licence issued under the Arms Act, 1959 (Act 54 of 1959), covering the period for which shooting permit is to be issued -

(a) for a permit in Form 'A' not earlier than four months and not later than fifteen days before the permit is required;

(b) for an extension of a permit not earlier than seven days before the expiry of the original permit.

(ii) (a) The Divisional Forest Officer may, for reasons to be stated in writing, refuse to issue a permit in any case.

(b) When the Divisional Forest Officer issues a permit he shall forward it to the applicant.

(iii) The person to whom a permit has been issued shall, within seven days of the receipt thereof, remit to the Divisional Forest Officer, the fee payable for such permit together with the royalty of the game allowed to be killed.

(iv) It the fee and the royalty payable in respect of a permit is not paid within the time prescribed by Clause (iii) the permit shall be deemed to be cancelled and the Divisional Forest Officer shall inform the applicant of such cancellation.

(2) In case of a free permit to be issued under Rules 7 (b), 8 and 9, applications shall be made to the authority specified in these rules with the proof of a valid licence under Arms Act, 1959 (Act 54 of 1969).

(3) Every shooting permit shall be issued in the name of the person only and shall not be transferable. The death of the permit-holder or the cancellation of his licence under the Arms Act, 1959 for whatever cause, shall automatically cancel his permit under these rules.

(4) (i) The permit-holder shall notify the local Range Officer, at least 24 hours in advance of his entering the shooting block wherein he has been authorised to hunt. This period may be reduced in case of a free permit by the permit issuing authority.

(ii) If the shooting block is not occupied within two days from the date from which it is reserved and if the permit-holder falls to express his intention to avail himself of the reservation at a later date during the period for which the block is reserved, the reservation of the same shall automatically stand cancelled and no refund of fee, if any paid, except the royalty, shall be made.

11. Restriction on 11 number of beaters, followers etc. - The competent authority may enter in the permit-

(a) the maximum number of persons entitled to shoot in addition to the permit-holder;

(b) the maximum number of retainers or followers or beaters or dogs or other animals which the permit-holder may take into the forest for retrieving or flushing purposes;

(c) the maximum number of elephants which the permit-holder may take to the forest or for which he may obtain fodder from the forest;

(d) the particular area or location in the shooting block, where beating, for any reason, may be prohibited.

The permit-holder shall abide by the conditions of such permit.

12. Scope of permit. - (1) The permit shall be valid -

(a) for use by the person or persons in whose name it is issued and for the period specified therein ; and

(b) for the shooting block or area specified therein :

Provided that a wounded animal may be followed into any other block or area for the purpose of killing it, except a Park or Sanctuary in which case the Divisional Forest Officer shall be informed immediately who shall arrange to kill it.

(2) The permit-holder shall not kill any wild animal during the close season, nor shall kill any wild animal not covered by his permit nor exceed the number allowed.

(3) A permit-holder shall on demand by a Magistrate, Forest Officer or Police Officer having jurisdiction in the locality produce his permit.

(4) Camping site - While inside his shooting block, the holder of a shooting permit shall camp only at such camping grounds as are entered in the permit, or have been set apart by the Divisional Forest Officer or in places specially pointed out to him by the Range Officer.

13. Return of permit and game record. - On a permit-holder vacating the shooting block for which he holds permit, he shall return his permit to such official as may be mentioned on it or shall send by registered post to the office of issue within a fortnight of its expiry after making entry in the form of game record, the number and species of all game killed by him and his party and any infringement of the Forest Laws and rules or conditions of his permit that may have been committed. He shall also furnish in the said return the area in the shooting block where beats had been made for the purpose of shooting and any occasion on which he has persuaded wounded game outside his shooting block and the nature of game seen by him. He shall also make arrangement to take refund of royalty already paid for game which he did not kill or take.

14. (1) In case of refusal to renew a shooting permit the loyalty not covered by games killed or captured shall be refunded to the applicant.

(2) In case of the loss of a shooting permit, a duplicate copy of the permit shall be issued by the permit issuing authority after charging Re 1.

15. Fees and royalties. - (1) The shooting permit fee for a period of 15 days or less shall be Rs. 25 for a citizen of India and Rs. 50 for a person other than a citizen of India.

(2) The permit-holder shall pay in advance the royalty payable for the animals that he is permitted to kill according to the rates of royalty specified in Schedule IV. He shall get a refund of the royalty for game not killed or taken by him when he vacates the block after returning the permit showing the details of game killed or taken.

16. Conditions governing issue of permit. - (1) Save and except under Rules 8 and 9, no permit shall be issued for killing of wild animals specially protected under the provisions of the Wild Birds and Animals Preservation Act, 1912 and no permit shall be issued during the closed season.

(2) No permit shall be issued for a period longer than 15 days and more than one permit shall not be granted for the same period or for different periods overlapping one another in the same shooting block.

(3) No permit shall be granted in any shooting block before the expiry of fifteen days from the expiry of the permit last granted in such block :

Provided that on the expiry of his permit, a permit-holder may, for special reasons and at the discretion of the Divisional Forest Officer, be granted an extension of his permit for a further period not exceeding 7 days on payment of half fees together with the royalty, if any, to be paid for animals to be allowed.

17. Persons to whom permits are granted under Rules 8 and 9 shall -

(a) before shooting, hunting or fishing in any reserve forest, inform the Divisional Forest Officer of their intention and of the area in which they propose to shoot, hunt or fish and shall not shoot, hunt or fish unless they have ascertained that there is no objection to their doing so;

(b) not shoot or capture any animal not mentioned in the permit or shoot or capture more than the number of such animals as endorsed on the permit;

(c) pay in advance the royalty for the game to be killed during the period which should not exceed 15 days at a time in a particular block;

(d) not tie up baits or beats in any block during the period for which a permit granted to any other person for such block has been issued, and for fifteen days after such period except with the permission in writing from the Divisional Forest Officer :

Provided that i.e may , with the permission of such permit-holder, if he is present, or without his permission, if he is absent, stalk or track in such shooting block;

(e) observe all the provisions of these rules

(f) furnish a return similar to that prescribed in Rule 13 for each block to the Divisional Forest Officer on the last day of every period during which they have been allowed to shoot in the forest.

18. Shooting of leopard. - (1) No permit shall be granted to any person for more than one leopard unless it is a declared man-eater or cattle lifter in one open season.

(2) A permit-holder intending to sit on a 'Machan' for hunting a leopard during the hours of night, i.e. one hour after sunset and one hour before sunrise shall inform the local Range Officer of his intention to do so.

(3) No bait alive or dead tied up for leopard shall be removed by any one except with the permission of the permit-holder.

(4) Cubs or female leopard with cubs shall not be shot.

Explanation - Unless declared as dangerous male leopard under six feet and female leopard under five feet shall be considered as cubs.

19. Fishing. - (1) Fishing by any means is prohibited inside the reserve forest except with a valid permit issued by the divisional Forest Officer.

(2) Fishing under a permit shall be allowed for the use of rods or lines only.

20. Shikaries and Shikar Agents. - (1) No Shikari shall be granted recognition licence unless he has been engaged in acting and handling 'Shikar' parties at least for a period of one year before the date of application.

(2) No Company or Shikar Agent shall be registered unless it or he has been registered and recognised as such, by the Government of India, Ministry of Transport wing under its 'Rules for Recognition of Shikar Agents' issued under its circular letter No. 23-77 (1)/52, dated the 30th November, 1954, as revised from time to time.

(3) The registration fee for the recognition licence shall be as follows for a shooting season

    (i)

    Shikari

    Rs. 20.00

    (ii)

    Company of Shikar Agent

    Rs. 250.00

(4) The recognition licence shall be issued in Form 'D' annexed to these rules in the name of the Shikari for a Block or Blocks within a Division, as the officer authorised in this behalf may consider necessary and in the name of the Shikar Agent or Company for the whole State or any part thereof. The licence for Shikari shall be issued by the Divisional Forest Officer and by the Wild Life Conservation Officer for Shikar Agent and Company.

(5) The Company or Shikar Agent or Shikari granted recognition shall observe all the provisions of these rules, failing which the recognition is liable for cancellation.

(6) All recognised 'Shikar Agents' or Companies or Shikaries shall furnish to the licencing authority the information required to be filled by the permit-holder under Rule 13.

21. Cancellation of permit. - A shooting permit may after giving a reasonable opportunity to the permit-holder of being heard be cancelled at any time by the Divisional Forest Officer, or Conservator of Forests or Chief Conservator of Forests, if any breach of the Forest Act or of any rule made thereunder is committed by the holder of a permit or any of his retainer or follower.

On such cancellation the whole party shall quit the forest immediately and any royalty paid for animals not killed or caught shall be refunded.

22. Appeal. - An appeal from any order passed by the Divisional Forest Officer under any of the preceding rules shall lie to the Conservator of Forests and from that passed by the Conservator of Forests to the Chief Conservator of Forests whose decision shall be final.

23. Nothing in these rules shall be deemed to apply to the capture or killing of a wild animal by any person in defence of himself or any other person or in bona fide defence of property.

24. General. - Any wild animal found dead or killed or captured without a permit in defence of life or property or any game or trophy in respect of which a breach of the provision of these rules has been committed, shall be the property of the Government. Any person who by any means obtains possession of such wild animal shall within forty-eight hours make a report thereof to the nearest Forest Officer or a Police Officer and shall, if so required, hand over the same to such officer. Such Officer shall bring it to the notice of the Divisional Forest Officer at once for its disposal.

25. Any person or persons giving information which may lead to conviction of any person for contravention of the provision of these rules, shall be entitled to reward which may at the discretion of the Magistrate trying the case extend to the full amount of the fine as inflicted by the Magistrate or any case of compensation realised by the officer empowered in this behalf up to the limit of half the compensation realised by the officer empowered to do so.

Note - Government employees who give such information shall not be debarred from receiving the above reward.

26. Registers and record. - The Divisional Forest Officer shall maintain a record in Form 'E' of all game killed in any reserved or protected forest under his charge and shall submit to the Conservator of Forests at such times as the latter may direct, a return in Form 'F' under intimation to the Wild Life Conservation Officer.

27. Register. - The permit or recognition licence issuing authority shall maintain record of all permits and licences issued or renewed.

28. Repeal and saving. - (1) All rules corresponding to these rules made under the Indian Forest Act, 1927 (Act 16 of 1972) and the Madras Forest Act, 1882 (Madras Act 5 of 1882) are hereby repealed.

(2) Notwithstanding such repeal all notifications and orders issued, all acts done and all prosecutions lodged in the Courts of Law in accordance with the provisions of the rules so repealed shall be deemed to have been issued, made and lodged under appropriate provisions of these rules.
