S.R.O. No.379/2004. - Whereas the draft of the Orissa Municipal Corporation Rules, 2004 was published as required by Sub-section (1) of Section 656 of the Orissa Municipal Corporation Act, 2003 (Orissa Act 11 of 2003), in the extraordinary Issue No.215 of the Orissa Gazette, dated the 10th February 2004, under the notification of the Government of Orissa in the Housing and Urban Development Department No.2881-Legislative-1-53/03-HUD, dated the 5th February 2004, as S.R.O. No.72/2004, inviting objections and suggestions from all persons likely to be affected thereby within a period of fifteen days from the date of publication of the said notification; And whereas the objections and suggestions received within the stipulated period in respect of the said draft have been duly considered by the State Government; Now, therefore, in exercise of the powers conferred by Sub-section (1) of Section 656 of the Orissa Municipal Corporation Act, 2003 (Orissa Act 11 of 2003), the State Government do hereby make the following rules, namelyChapter-I
Preliminary
1. Short titles and commencement. - (1) These rules may be called the Orissa Municipal Corporation Rules, 2004. (2) They shall come into force on the date of their publication in the Orissa Gazette. 2. Definitions. - (1) In these rules, unless there is anything repugnant in the subject or context(a) "Act" means the Orissa Municipal Corporation Act, 2003 (Orissa Act 11 of 2003);
(b) "Appendix" means an Appendix appended to these rules;
(c) "Mayor" means the Mayor of the Municipal Corporation;
(d) "Permanent building" means a building, which is constructed for permanent use with stone, mud, brick, mortar, cement or other non-inflammable materials.
(e) "Schedule" means a Schedule appended to these rules;
(f) "Section" means a section of the Act; and
(g) "Temporary building" means a building which is not a permanent building;
(2) The words and expressions used but not defined herein shall have the same meaning as respectively assigned to them in the Act.Chapter-II
Powers and Duties of Corporation Authorities
3. Standing Committee for Taxation, Finance and Account. - The Standing Committee for Taxation, Finance and Accounts shall have the powers to recommend to the Mayor measures to be taken with regard to the Annual, interim and revised budget estimates, keeping in view the need of the city vis-a-vis the availability of funds of the Corporation without encroaching Government grants and loans. 4. Standing Committee for Public Health etc. - The Standing Committee for Public Health, Electric Supply, Water Supply, Drainage and Environment shall have the powers to recommend to the Mayor measures to be taken with regard to the following matters in order of priority as provided under Sections 24 and 25 keeping in view the need of the city vis-a-vis the availability of funds of the Corporation without encroaching Government grants and loans, namely :-(i) the watering, scavenging, and cleaning of all public streets and places in the city and removal of all sweepings there from;
(ii) the collection, removal, treatment disposal of solid wastes, sewage, offensive matters and rubbish and the preparation of compost manure from such of solid wastes, sewerage, offensive matters and rubbish;
(iii) the construction, maintenance and cleansing of drains and drainage works and of water closets, urinals and similar public conveniences; and
(iv) the lightening of public buildings vested in the Corporation, public streets and Corporation parks.
5. Standing Committee for Public Works. - The Standing Committee for Public Works shall have the powers to recommend to the Mayor measures to be taken with regard to the matters relating to buildings, roads and bridges, pathways, drains and sewerage, general improvement works keeping in view the need of the city vis-a-vis the availability of funds of the Corporation without encroaching Government grants and loans. 6. Standing Committee for Planning and Development. - The Standing Committee for Planning and Development shall have the powers to recommend to the Mayor measures to be taken with regard to the matters relating to Urban Planning including town planning, slum improvement, up-gradation and development and development of fringe area, keeping in view the need of the city vis-a-vis the availability of funds of the Corporation without encroaching Government grants and loans. 7. Standing Committee for Education. - The Standing Committee for Education, Recreation and Culture shall have the powers to recommend to the Mayor measures to be taken with regard to the following matters keeping in view the need of the city vis-a-vis the availability of funds of the Corporation without encroaching Government grants and loans, namely :-(i) Promotion of Cultural, Educational and Aesthetic aspects; and
(ii) Provision of Urban amenities and facilities such as Parks, Gardens, Playgrounds etc.
8. Standing Committee for licence. - The Standing Committee for licence and Appeal shall have the powers to aid and advise the Mayor in various licensing system. In general E-Governance may be adopted for bringing transparency in the system and for convenience of citizens. 9. Standing Committee for Contracts. - The Standing Committee for Contracts shall have the powers and functions with regard to matters to be decided by the Mayor in connection with execution of Contracts and finalisation of tenders. 10. Standing Committee for Corporation Establishment. - The Standing Committee for Corporation Establishment shall have the powers to recommend to the Mayor measures to be taken with regard to the following matters keeping in view the need of the city vis-a-vis the availability of funds of the Corporation without encroaching Government grants and loans, namely :-(i) Creation of posts, and
(ii) Recruitment of the staff of the Corporation,
11. Standing Committee for Grievance and Social Justice. - The Standing Committee for Grievance and Social Justice shall have the powers to recommend to the Mayor measures to be taken with regard to the following matters keeping in view the need of the city vis-a-vis the availability of funds of the Corporation without encroaching Government grants and loans, namely :-(i) Planning for Economic and Social Development, and
(ii) Safeguarding the interests of weaker sections of society, including the handicapped and mentally retarded.
12. Powers of the Commissioner. - (1) The Commissioner may, with the approval of the Mayor, engage private firms to discharge such duties when he feels that a particular service or work discharged by the Corporation employees is not efficiently and effectively carried out, leading to leakage of revenue, and causing inconvenience to the citizens. (2) The Government may also direct the Commissioner to discharge such work through private initiation with the objective to provide better service to the public, when the Government feels that the services rendered by the Corporation through its employees are not efficiently discharged leading to leakage of revenue, and causing inconvenience to the public, and the Commissioner shall carry out such direction with the approval of the Mayor. (3) The Commissioner, with the approval of the Mayor, authorise any officer to remain in charge of any section or job other than the job assigned to him. (4) The Mayor shall be the appointing authority in respect of only Group-C categories of Corporation employees except the posts of Establishment Officer and in case of Group-D employees the Commissioner shall be the appointing authority. 13. Sitting allowance of Corporator and members of the Standing Committee. - (1) Every Corporator shall receive sitting allowance of rupees five hundred per month for every ordinary meetings of the Corporation and rupees two hundred for every extraordinary meeting out of the Corporation Fund. (2) Every member of the Standing Committee including the Chairman shall receive sitting allowance of rupees two hundred per month for every meeting of the Standing Committee. 14. Monthly remuneration of Mayor and Deputy Mayor. - The Mayor and the Deputy shall receive monthly remuneration of rupees six thousands and rupees four thousands respectively out of the Corporation Fund. 15. Travelling allowance of Mayor, Deputy Mayor and Corporator. - The Corporators shall be entitled to receive travelling allowance at the rate and as admissible, to a Group-A officer of the Government and the Mayor and the Deputy Mayor shall be entitled to receive travelling allowance at the rate as admissible to the Commissioner. 16. Obligation of the Commissioner. - The Commissioner shall carry out the decision of the Corporation as per the provisions of the Act, rules and regulations made there under.Chapter-III
Officers and Establishment of the Corporation
17. Appointment of officers by the Government. - In each Corporation, the posts mentioned in column (2) of Schedule A shall be filled up by Government by appointment of officers of the cadre specified in the corresponding entries in column (3) thereof in such number as specified in column (4) against each such post. 18. Minimum and Maximum age limit for appointment. - The minimum and maximum age limit for entry into Corporation Service shall be the same as respectively applicable to each of the posts under the state Government: Provided that in special circumstances the Corporation may, with the prior approval of the Government, by resolution relax the maximum age limit for entry into any service under the Corporation. 19. Date of Superannuation. - (1) The date of retirement on superannuation of a Corporation employee shall be the date on which such employee attains the age of fifty-eight and sixty years respectively as applicable in case of their counterpart in Government service. (2) The Corporation shall, on completion of fifty-five years of age, conduct a review in respect of all Corporation employees excepting the deputationists and determine whether such employee shall be allowed to remain in service up to the date of superannuation or retire on completion of fifty-five years in public interest. (3) A Corporation employee may retire from service at any time after completing thirty years of qualifying service or on attaining the age of fifty years by giving a notice in writing to the Corporation at least three months before the date on which such employee desires to retire. (4) The Corporation may withhold permission to an employee seeking retirement under Sub-rule (3) if,-(i) such employee is under suspension; or
(ii) enquiries against such employee are pending.
(5) The Corporation may also require a employee to retire from service in public interest at any time after completing thirty years of qualifying service or on attaining the age of fifty years by giving a notice in writing to such employee at least three months before the date on which such employee requires to retire by giving three months pay in lieu of such notice. 20. Maintenance of Service Book. - (1) A Service Book shall be maintained as specified in the form in Appendix-I for every officers and employees of the Corporation. (2) The Commissioner or any other officer duly authorised by him shall be responsible for the correct and up-to-date maintenance of the service book and shall record and annual certificate of verification in the Service Book relating to the office establishment at the end of every year. 21. Maintenance of CCRs. - (1) A Confidential Character Roll shall be maintained in the form specified in Appendix-II for each officer and employee of the Corporation except Group 'D' employees and the officers of Group 'A' and 'B' those who are on deputation. The officers of Group 'A' and 'B' who are on deputation shall submit their CCRs by self assessment. (2) Confidential Character Roll shall be maintained in duplicate. The original copy shall not be removed from the office having custody of it and the duplicate copy shall be circulated for purpose of promotion, selection, etc. 22. Custody of CCR. - (1) An officer of the Corporation shall be put in charge of the Confidential Character Rolls by the Commissioner. (2) Such officer shall ensure the safe custody, timely receipt and review of Confidential Character Roll. (3) He shall also be responsible for communicating adverse remarks in time, processing representations and communicating final decisions. 23. Report Period. - Confidential Character Roll shall be maintained financial year wise and the report period shall be from 1st April to 31st March. Remarks shall not be recorded in the Confidential Character Roll before 31st March except in the event of transfer of the officer recording the comments or the employee himself. 24. Levels of Assessment. - (1) There shall ordinarily be three levels of assessment, i.e. reporting authority, countersigning authority and accepting authority. (2) The reporting authority shall be the officer who is in immediate supervision and control of the employee. He shall initiate the Confidential Character Roll in case of Corporation employees and the deputationists in the rank below Group-'B'. The Commissioner shall be the countersigning authority and the Mayor shall be the accepting authority. (3) In case of all officers in the rank of Group-'B' and above the Municipal Commissioner shall be the initiating authority, Mayor shall be the countersigning authority and the Minister in charge shall be the accepting authority. 25. Service Conditions. - (1) The Orissa Service Code with all its Appendices, except Appendices 1 to 4, 8 and 12 as amended from time to time by the Government shall apply to the Group 'A' and 'B' employees of Corporation Services. The words 'Government', 'Government servant' and 'Head of Department' wherever occur except in Chapter I of the Code shall mean respectively the 'Mayor', 'Corporation Employees' and 'Commissioner'. (2) Notwithstanding any thing contained in any other rule in force for the time being, the Orissa Travelling Allowance Rules as amended from time to time by the Government shall apply to such employees of Corporation Services in the same manner as those of Government servants of similar standing and status. (3) Provisions of the Orissa Government Servant's Conduct Rules, 1959 shall mutates mutandis apply to the Corporation employees. (4) The Commissioner or any officer authorised by the Commissioner shall have the power to sanction travelling allowance, leave, annual increment and medical advance etc. of the Corporation employees including the employees on deputation, wherever necessary. The Major shall sanction the TA and DA etc. of the Mayor, Deputy Mayor and the Corporators. (5) In the matter of taking disciplinary action against an employee in Corporation Service the procedure laid down in the Orissa Civil Services (Classification, Control and Appeal) Rules, 1962 shall be followed. (6) Reservation of vacancies in the posts and services for the candidates belonging to Schedule Caste, Scheduled Tribes, Backward Class of Citizens and Women under the Corporation establishment shall be in the manner as applicable to the posts and services in the Government from time to time. 26. Local Fund Service Employees. - (1) The Orissa Local Fund Service employees serving under the Municipal Corporations shall exercise their option specified in Appendix-III, either to be absorbed in Corporation service or to be retrenched from the services of the existing Municipal Corporation, within a period of six month from the date of final publication of these rules in the Orissa Gazette, before the Commissioner. (2) The option form duly filled in shall be submitted before the Commissioner and the Commissioner with his signature on such Form, shall forward the same to the Government. (3) Those employees, who shall exercise their option to be retrenched from the Corporation Services, shall be posted to the Municipalities where there are vacancies in the respective posts held by them.Chapter-IV
Finance Rules
27. Regulation for budget and keeping of accounts. - The Corporation shall decide -(a) the manner and the Form in which the Budget Estimates, Budget Statements and Return of the Corporation shall be kept; and
(b) the manner and the Form in which the accounts of all financial transactions of the Corporation shall be kept.
28. Ward wise provision. - Budget provision of the Corporation shall be made ward-wise. 29. Payment out of the Corporation Fund. - The payment of any sum out of the Corporation Fund may be made or authorised by the Commissioner -(i) if such sum is covered by a budget grant under Section 155 and sufficient balance of such budget grant is available; and
(ii) in the absence of budget provision, in any of the cases referred to in the proviso to Section 155.
30. Commissioner's power of sanction. - The Commissioner may sanction any item or class of items for which provision has been made in the budget for an amount not exceeding rupees five lakhs and beyond rupees five lakhs with the sanction of the Mayor.Chapter-V
Public Works
31. Annual Statement of Work. - (1) The City Engineer shall, before the preparation of budget and final selection of works, furnish a statement of works with estimated cost to be executed during the ensuring year to the Standing Committee for Public Works. (2) The Commissioner shall take up the repair works and contingency expenditure of rupees one lakh. Beyond rupees one lakh approval of Mayor shall be required. (3) The works shall be taken up on any land vested with the Corporation, and the Corporation may take up any work on the land or property owned by the Government or any other authority with their written consent in the larger interest of the public. 32. Basic Schedule of Rates. - (1) The Government in Works Department basic schedule of rates and extra percentage permissible for any local area shall be adopted by the Corporation for the Corporation works. (2) All estimates shall be prepared in accordance with the current schedule of rates approved by the Works Department. (3) All changes in the scheduled rates during the currency of the year shall, likewise, be applicable for Corporation works. (4) The schedule of rates of the Public Health Engineering Department shall be adopted in support of sanitary projects. 33. Classification of works. - (1) Corporation works shall be divided into two parts, namely :-(a) original works and
(b) repairs or maintenance.
(2) Original works include new constructions whether entirely new or of addition and alternation to existing works. (3) The decision of the Inspector of local works regarding classification of works as Original or repair shall be final. 34. Preparation of plans and estimates. - Plan and estimates for the Corporation works to the original or repairs, shall ordinarily be prepared by or under the supervision of City Engineer. 35. Financial limit for technical sanction. - (1) The final limit for technical sanction of Inspector of Local Works or Chief Engineer, City Engineer, Executive Engineer, Assistant Executive Engineer and Assistant Engineer of the Municipal Corporation shall be a specified in Schedule B. (2) The technical sanction of the functionaries specified in Sub-rule (1) shall be obtained to the plan and estimates relating to Corporation works. (3) The City Engineer or any engineer not below the rank of Assistant Engineer authorised by him shall be in charge of the work executed by the Corporation who may be assisted by the Junior Engineers concerned. 36. Regulation for Tender. - The Corporation works shall be put to tender, provided the estimated cost of the work of which is less than rupees three lakhs can be taken up departmentally, with the approval of the Mayor. 37. Inspection of local works. - (1) The Chief Engineer, Public Health (Urban) shall be the Inspector of Local Works for the Municipal Corporation. (2) The Inspector of Local Works shall be the Advisor to the municipal Corporation with regard to matters referred to him by the Commissioner. 38. Powers and duties of Inspector of Local Works. - (1) The Inspector of Local Works may conduct inspection of any Corporation works. (2) He shall inspect the office of the City Engineer of the Municipal Corporation at least twice a year. The Commissioner shall take action on the Inspection notes of the Inspector of Local Works. (3) The Inspector of Local Works may call for and examine any bills relating to any work whether complete or in progress and may disallow or reduce payment for any item of work included in such bills. (4) The City Engineer of the Municipal Corporation may correspond directly with the Inspector of Local Works with regard to professional or technical advice, which he may seek from Inspector of Local Works and the Inspector of Local Works may tender such advice direct to him and in such case the City Engineer shall keep the Commissioner informed of the same. (5) The Inspector of Local Works shall help to prepare designs of Important Local Work of the Municipal Corporation and he shall communicate freely and personally on all professional matters with the Engineer of the Municipal Corporation and afford him the benefit of his advice in performance of his duties. (6) The Inspector of Local Works shall check and accord technical sanction of local works when submitted to him by the City Engineer.Chapter-VI
Regulation of Factories, Trades and Operations and Protection and Development of Heritage Buildings
39. Things not be kept and trades not to be carried on without licence. - Except under and in conformity with the terms and conditions of licence granted by the Commissioner, no person shall -(a) keep in any premises, for any purpose whatsoever,-
(i) any article specified in Part I of Schedule C as provide; and
(ii) any article specified in Part II of Schedule C in excess of the specified quantity as provided; and
(b) keep in any premises, for sale or for use other than domestic use, any article specified in Part III of Schedule C as provided under clause (b) of Sub-section (1) of Section 554.
(c) carry on or allow to be carried on, in any premises, any of the trades specified in Part IV of Schedule C, or any process or operation connected with any such trade.
(d) engage in any trade or manufacture specified in Schedule C shall do any act prohibited under Sub-section (1) of Section 555.
(e) In case of illegal encroachments for trade activities, if such construction is demolished by the Corporation, then the cost of demolition of buildings and illegal structures shall be borne by the encroacher. In case of reconstruction in those area, if any, is proved, the penalty will be charged in double.
In case of archaeological sites and heritage buildings situated within the Corporation area.it is obligatory on the part of the Corporation to upkeep, maintain and upgrade such sites and buildings.Chapter-VII
Places of Public Resort and Entertainment
40. Condition of licence in respect of permanent buildings. - (1) No licence shall be granted by the Commissioner under the Act for use of any permanent building for public resort or entertainment unless -(a) the building is provided, with open space as may be prescribed in the Building Regulation of concerned Development Authorities;
(b) the excavate of the building have a height of not less than ten feet;
(c) every door-way in the building is not less than eight feet in height and five feet in width; and
(d) the windows of the building are of such dimensions and number and in such situations as may be required by the Commissioner and the aggregate area of all the windows in each of the places to which the public are admitted is not less than one-tenth of the floor area thereof.
(2) Every person who on receipt of a licence under the Act for use of any permanent building for public resort or entertainment shall cause all windows and other means of ventilation in the building to be maintained in good order and repair during the period such building is used for public resort or entertainment and for at least two hours before and for half-an-hour after such use. 41. Liability and disability of the licence in respect of permanent buildings. - (1) The licensee shall, except when such building is used in day time and no artificial lighting is required, provide suitable lighting herein and the open space attached thereto. (2) The licensee shall cause the flooring of every part of such building to be paved or otherwise made imperious and damp-free and shall keep such flooring at all times in good order and repair and shall disinfect it at such times and in such manner as may be required by the Commissioner. (3) The licensee shall not permit any sand, earth or other dusty material to be spread on any part of the floor of the building to which the public are admitted. (4) The licensee shall cause the carpets, matting or any other material used as a covering of the floor to be cleaned at least once daily. (5) The licensee shall cause all open spaces in the licensed premises to be paved or gravelled as may be required by the Commissioner. (6) The licensee shall not permit a greater number of persons to be accommodated in the building than that arrived at by calculating at the rate of 20 persons per 100 square feet of floor area in respect of such persons as are provided with chairs, having backs and arms, and at the rate of 25 persons per 100 square feet of floor, after excluding the area of the entrances, the passages and gangways, the stage, the staircases and all places to which the public are not admitted. (7) The licensee shall cause a board to be hung in a prominent place in the licensed premises showing the maximum number of persons who can be accommodated in the building under this rule. (8) The licensee shall provide separate and reasonably sufficient accommodation for women. (9) The licensee shall cause the walls of the building to be hot lime washed at least once in every six months or to be painted once in every two years or more as may be required by the Commissioner. (10) The licensee shall cause the premises to be thoroughly cleaned and all refuse matter to be removed at least once in every twenty-four hours or more as may be required by the Commissioner. (11) The licensee shall provide suitable means of drainage to the building and also sanitary conveniences as may be required by the Commissioner. (12) The licensee shall, where a continuous supply of piped water is available, provide such number of water taps and in such places as may be required by the Commissioner. (13) The licensee shall, where a continuous supply of piped water is not available, provide drinking water in such places, in such manner and in such quantity as may be required by the Commissioner. (14) The licensee shall provide spittoons of such description, in such number and in such places as may be required by the Commissioner. (15) The licensee shall provide fire services installations on the recommendation of the fire officer. 42. Conditions of licence in respect of temporary building on enclosures. - (1) No licence shall be granted by the Commissioner under the Act for the use of any temporary building for public resort or entertainment unless -(a) the building is provided on all its sides with an open space which in no part thereof shall be less than five feet in width :
Provided that the Commissioner may grant a licence for any such building with an open space of not less than three feet in width :(b) the eaves of the building have a height of not less than eight feet; and
(c) every door-way in the building is not less than six feet in height and four feet in width.
(2) Every person, who on receipt of a licence under the Act for the use of any temporary building or any enclosed place for public resort or entertainment, shall provide suitable means of ventilation for such building or place and shall cause the same to be maintained to the satisfaction of the Commissioner. He shall also, except when such building or place is used in day time and no artificial lighting is required, provide suitable lighting therein. (3) The licensee shall provide fire service installations on the recommendation of the fire officer. 43. Liability and disability of licence for temporary buildings and enclosures. - (1) The licensee shall cause every part of such building or place to be maintained in proper sanitary condition. (2) The licensee shall not permit a greater number of persons to be accommodated in the building than that arrived at by calculating at the rate of 25 persons per 100 square feet of floor area after excluding the area of the entrances, the passages, and gangways, the stage, the staircases and places of which the public are not admitted. (3) The licensee shall provide such sanitary convenience as may be required by the Commissioner for the exclusive use of each sex and shall cause the same to be maintained in good order and sanitary condition. (4) The licensee shall provide a sufficient supply of wholesome drinking water for the use of person employed in or frequenting such building or place. The quantity and the places and the method of storage and supply shall be as may be required by the Commissioner. (5) The license shall not permit -(a) any light to be affixed to the side walls;
(b) any light to be placed within five feet of the side walls or roof of such building or place; and
(c) any fire work to be ignited within 100 feet of any part of the outer walls or such building or place.
44. Nature of the licence. - (1) Licence granted under the Act by the Commissioner may be either annual or temporary. (2) Temporary licence may be granted -(a) in the case of a building or enclosure used for a travelling circus or show, for a period not exceeding one month at a time; and
(b) in other cases for a period not exceeding three months at a time.
(3) Annual licences shall be granted only in respect of permanent building, but temporary licences may be granted in respect of such buildings if they are required only for occasional use for such places of public resort or entertainment. (4) Temporary licences may only be granted in respect of temporary buildings. (5) In respect of walled enclosures, which have no roof or super structure, either annual or temporary, licences as deemed proper may be granted. (6) Any licence granted may, from time to time, be renewed at the discretion of the Commissioner-(a) in the case of an annual licence, for further period of one year at a time; and
(b) in the case of a temporary licence for such further periods as the Commissioner may think fit, but not exceeding at a time period specified in clause (a) or clause (b) of Sub-rule (2), as the case may be.
45. Prohibition of use of buildings. - In the event of an out break of an epidemic or contagious disease in the locality, the Commissioner shall by order direct that any building or enclosed place, in respect of which a licence has been granted under the Act, shall not be used for purposes of public resort or entertainment for such period as may be specified in the order, if in the opinion of the Commissioner, such use is likely to spread the epidemic or contagious disease. The Commissioner shall also have power to refuse to grant a licence in similar circumstances. 46. Licence fee. - The corporation may charge a fee for every licence, permanent and temporary, granted or renewed under the Act in respect of a permanent building and temporary building. 47. Additional condition of licence. - Every licence granted under the Act shall be subject to the following additional conditions, namely :-(1) No fire or naked light shall under any circumstances be allowed inside the licensed premises.
(2) All swinging light shall be suspended by metal wire or rods.
(3) No inflammable or explosive substance, such as petroleum, Kerosene oil, fire works or gunpowder, in exceeds of the quantity required for one-day use, shall be stored within the licensed premises.
(4) No structural or material alteration shall be made in the licensed premises except with the written permission of the Commissioner.
(5) No leper and no person suffering from an open sore or any loathsome infectious or contagious disease shall be permitted inside the licensed premises, if such person is found in any such premises, the licensee shall immediately report the fact to the Commissioner and the licensee shall at his own cost take such steps as may be required by such officer to disinfect the place and to prevent further spread of infection.
(6) The licensed premises shall not be kept open after 2 A.M. till 4.00 A.M. without special permission from the Commissioner.
(7) The licence shall not be transferred except with the prior permission of the Commissioner.
(8) The Commissioner or any subordinate officer duly authorised by the Commissioner during any entertainment in the licensed premises shall, at all times, have free access to the said premises to see whether the conditions of the licence are fulfilled.
(9) The Commissioner may add such other conditions not inconsistent with these rules, to the licence as he may deem necessary in the interest of the health or safety of the public.
Note:- Section 613 of the Act and Rules 40(1)(2), 41, 42(2), 43 and 47 shall be printed at the foot of the licence granted.
48. Continuance of the power of Development Authorities. - (1) The planning performance of functions and implementation of schemes in relation to urban planning including town planning shall continue with the respective Development Authorities : Provided that -(i) the Development Authority shall take the advice of the Standing Committee for Planning and Development; and
(ii) the Standing Committee for Planning and Development may recommend measures to the concerned Development Authority.
(2) The Building Regulation shall remain in force in the Corporation area and concerned Development Authorities shall exercise the powers conferred on them in the Building Regulation in such area. 49. Public Utility Office. - There shall be a Public Utility Cell of the corporation in each ward.Schedule A
