Government of Punjab Department of Education (Education-IV Branch)No. G.S.R.47/P.A.-26/98/Section 11/99. - In exercise of the powers conferred by section 11 of the Punjab Education Development Act, 1998 (Punjab Act No. 26 of 1998), and all other powers enabling him in this behalf the Governor of Punjab is pleased to make the following rules, namely :- 1. Short title and commencement. - (1) These rules may be called the Punjab Education Development Rules, 1999. (2) They shall come into force on and with effect from the date of their publication in the Official Gazette. 2. Definition. [Section-2] - In these rules, unless the context otherwise requires. - (1) "Act" means the Punjab Education Development Act, 1998. 3. Maintenance of Accounts. - (1) The accounts of the Board shall be maintained on the basis of financial year. (2) All funds belonging to the Board shall be kept by the Board, in the State Bank of India or in any other Scheduled Bank as the Government may direct. (3) The accounts of the Board shall be maintained by the Member-Secretary. (4) No transfer shall be made from one account to another account without the previous sanction of the Board. (5) All properties belonging to the Board shall be held in the name of the Board. (6) The Member Secretary shall take necessary action for drawing interest upon Government securities held by the Board. (7) Transfer of any Government security held by the Board shall be made with the previous approval of the Board. 4. Collection of cess. [Section 6(1)] - (1) The Department of Excise and Taxation shall collect the amount of cess in accordance with the rate notified by the Government under Section 6 of the Act. (2) The amount of the cess so collected under sub-rule (1), shall be transferred by the Department of Excise and Taxation direct to the Fund through bank draft or banker's cheque within a period of the first ten days of the month or the quarter of the financial year depending upon the unit of the period of collection of the cess. 5. Budget of the Board. [Section-3 and 11(2)(a)] - (1) The Board shall meet in the 1st week of February every year to finalise the budge for the ensuing financial year. (2) The Budget finalised by the Board shall be submitted to the Government for approval by the 1st week of February preceding the year to which the budget relates. (3) No expenditure shall be incurred by the Board unless there is a provision in the budget to expend. (4) While preparing the budget estimates of the Board, the interest accrued on the Government Securities or any other amount deposited in any Scheduled Bank by the Board or the interest likely to be accrued on the Government securities or other deposits of the Board, shall also be taken into account. (5) All sums due to the Board shall be received by the Member Secretary and the same shall be deposited forthwith in a Scheduled Bank. (6) All payments shall ordinarily be made on behalf of the Board by cheque to be signed by the Member Secretary. (7) All funds of the Board will be utilised only for the purpose specified in section-8 of the Act. However, Board may decide if any deviation is to be made. 6. Execution of work and mode of execution. - (1) The works which are to be executed with the financial assistance provided by the Act or these rules shall be executed through the agencies authorised by the Government. (2) The authorised agency shall submit utilisation certificate in respect of the financial assistance received and utilised by it. (3) The Board shall constitute a committee to check the inspect the works on which financial assistance provided by the Board, has been utilised. (4) The Committee, referred to in sub-rule (3), shall report to the Board in respect of the utilisation of the financial assistance and genuineness of the utilisation certificate, to the Board. 7. Contracts and Agreements. [Section-11] - (1) All contracts and agreements on the behalf of the Board shall be signed and executed by the Member Secretary.
