No. G.S.R. 99/C.A.5/23/Section 29/2001. - With reference to Government of Punjab, Department of Industries, Notification No. G.S.R. 23/C.A.5./23/S.29/89, dated the 8th February, 1989, and in exercise of the powers conferred by section 29 of the Indian Boilers Act, 1923 (Central Act No. 5 of 1923), the Governor of Punjab is pleased to make the following rules, namely :-

I-Preliminary

1. Short title and commencement. - (1) These rules may be called the Punjab Boiler Operation Engineers' Rules, 2001.

(2) They shall come into force at once.

(3) These rules shall be in addition to and not in derogation of the Punjab Boiler Attendant's Rules, 1961.

2. Definitions. - (1) In these rules, unless the context otherwise requires, -

(a) "Act" means the Indian Boilers Act, 1923 (Central Act No. 5 of 1923);

(b) "Boiler Attendant" means a Boiler Attendant, qualified under the Punjab Boiler Attendant's Rules, 1961;

(d) "Boiler Operation Engineer" means a person in whose favour a certificate of proficiency as a Boiler Operation Engineer has been granted under these rules;

(e) "Chairman" means the Chairman of the Board of Examiners;

(f) "Member Secretary" means the Member Secretary of the Board of Examiners, and

(g) "Section" means a section of the Act.

(2) Any reference in these rules to a boiler or boilers shall be deemed to include also a reference to an economiser, or economisers, respectively.

II-General

3. Boiler to be in charge of a person holding a Boiler Operation Engineer's Certificate. - (1) The owner of a single boiler or two or more boilers connected in a battery or of so many separate individual boilers installed in a power station within a radius of fifty metres shall not use the same or permit the same to be used unless the boiler or boilers as the case may be, is or are placed under the direct charge of a First Class Boiler Operation Engineer as specified in clause (1) of rule 4 in addition to such number of second Class Boiler Operation Engineers and Boiler Attendants as may be specified in writing by the Chief Inspector in this behalf.

(2) The owner of a single boiler or two or more boilers connected in a battery or of so many separate individual boilers installed in a premises other than the power station within a radius of fifty metres having a total heating surface exceeding seven hundred square metres in any of the cases, shall not use the same or permit the same to be used unless the boiler or boilers, as the case may be, is or are placed in direct charge of a Second Class Boiler Operation Engineer as specified in clause (2) of rule 4 in addition to such number of Boiler Attendants as may be specified in writing by the Chief Inspector in this behalf :

Provided that the Chief Inspector may, in the interest of power generation and industrial development, permit any boiler to remain under the charge of a person, who does not possess a certificate of proficiency as a Boiler Operation Engineer but possesses the requisite qualifications and experience as specified in rule 33, for a period not exceeding three months :

Provided further, that nothing in these rules shall debar a person holding a certificate of competency granted under the Punjab Boiler Rules, 1926 from remaining in attendance and in charge of a boiler or boilers, as the case may be, to the extent of his qualifications indicated in such certificate.

4. Possession of Certificate and Extent of Qualifications. - (1) No person who does not possess a First Class Certificate of proficiency as Boiler Operation Engineer granted under rule 39 shall be deemed to be a fit and proper person to hold the charge of a boiler or boilers installed in a Power Station, situated at a distance exceeding that specified in sub-rule (1) rule 3.

(2) No person who does not possess a Second Class certificate of proficiency as Boiler Operation Engineer granted under rule 39 shall be deemed to be a fit and proper person to hold the charge of a boiler or boilers installed in a premises other than the power station, situated at a distance exceeding that specified in sub-rule (2) of rule 3.

5. Production of a Certificate. - The holder of a certificate under these rules shall, at all reasonable times, during the period any boiler is in his charge, be bound to produce such certificate when called upon to do so any of the persons empowered under section 15 to call for the production of the certificate or provisional order authorising the use of the boiler.

6. Owner to furnish Chief Inspector with particulars of certificates. - (1) The owner of a boiler who engages any person to be incharge thereof, shall within seven days of such engagement, furnish the Chief Inspector with full particulars of such person including the serial number, date and place of issue of his certificate.

(2) The owner of a boiler who engages any person to hold charge of such boiler, in the event of such person leaving his employment or in the event of the death of such person shall report the fact within seven days to the Chief Inspector.

7. Limits of daily period of attendance, reliefs and sphere of action. - (1) A person, incharge of a boiler, shall be deemed to be in direct and immediate charge of the same when he is within the range of fifty metres of such a boiler,

(2) An Operation Engineer of a boiler or boilers for which a certificate of proficiency is required may be relieved of the charge by a person holding a first class certificate of competency as an attendant in any one day for not more than two periods, the total of which shall not exceed two hours :

Provided that the holder of a first class certificate of competency as an attendant may also with the consent, in writing, of the Chief Inspector, relieve a person holding a certificate of proficiency as an operation engineer for a period which may extend to ten consecutive days which, in special circumstances, the Chief Inspector may extend to any length of time but not exceeding thirty days at a time.

8. When boiler deemed to be in use. - (1) A boiler shall be deemed to be in use for the purposes of these rules, when there is fire in the furnace, fire box or fire place for the purpose of heating the water in the boiler or under banked fire condition. A boiler shall be deemed to be not in use only when the fire is removed and all steam and water connections are closed.

(2) An economiser or waste heat boiler shall be deemed to be in use for the purposes of these rules when there is a flow of heating gases or other heating media past the economiser or waste heat boiler and there is an appreciable heat transfer between the water and the heating gas media.

III-Board of Examiners

9. Constitution of the Board of Examiners. - (1) A Board of Examiners shall be constituted for the State of Punjab consisting of the Chief Inspector, the Deputy Chief Inspector or an Inspector nominated by the Chief Inspector and not less than three other members to be appointed by the State Government from time to time, having adequate theoretical and practical knowledge of modern boiler technology including accessories, instrumentation and control and prime movers thereof.

(2) The Chief Inspector shall be the ex officio Chairman and the Deputy Inspector or the Inspector, as the case may be, shall be the Member Secretary of the Board of Examiners.

10. Term of office of the members of Board of Examiners. - (1) The term of office of the members other than the ex officio member of the Board of Examiners shall be three years.

(2) If a member leaves the State of Punjab permanently or absents himself from three consecutive meetings of the Board of Examiners, he shall be deemed to have vacated his seat and another person shall be appointed in his place for the unexpired portion of his term.

11. Functions of the Board of Examiners. - (1) The, Board of Examiners shall, -

(i) conduct examination and practical tests of candidates for the grant of first class and second class certificate of proficiency as a Boiler Operation Engineer;

(ii) grant certificates of proficiency as a Boiler Operation Engineer; and

(iii) consider the reports of enquiries into the allegations of drunkenness, negligence of duty, misconduct on the part of Boiler Operation Engineers and shall take such action as it may consider necessary.

12. Meetings of Board of Examiners. - (1) The Board of Examiners shall meet as often as may in the opinion of the Chairman be necessary for transacting business which cannot be disposed of by circulation of papers.

(2) At least thirty clear days' notice of the date of meeting shall be sent to each member.

13. Quorum. - The Chairman or the Member Secretary and two members of the Board of Examiners shall form a quorum.

14. Chairman of the meeting. - The Chairman shall preside over all the meetings of the Board of Examiners and in his absence, a member chosen by the members present at the meeting shall preside over the meeting.

15. Functions of the Member Secretary. - The Member Secretary shall maintain a register of Boiler Operation Engineers holding certificates of proficiency and shall perform such other functions as are specified in these rules or as the Chairman may direct from time to time.

16. Endorsement on application. - The Board of Examiners shall endorse on the printed application form specified under rule 26 of each candidate the result of his examination for a certificate of proficiency as a Boiler Operation Engineer and the application so endorsed shall be returned to the Member Secretary.

17. Power to refuse to issue certificate. - The Board of Examiners may direct any candidate, who in the opinion of the majority of the members, appear to be too old or physically unfit due to some deformity, constitutional weakness, defective eye-sight, deafness or loss of limb, to perform efficiently the duties of a Boiler Operation Engineer, to produce a certificate of fitness from a Registered Medical Practitioner and in the event of his failure to do so, the Board of Examiners may refuse him the issue of a certificate of proficiency as a Boiler Operation Engineer.

18. Examiner's fees. - The fee after deduction of actual expenditure incurred in connection with the conduct of examination specified in clause (1) of rule 11, shall be divided between the members of the Board of Examiners, who take part in the examination of where there is no examination, between the members, who grant the certificates, and the staff dealing with the examination, in the ratio of 2 : 1 that is 2/3rd to the members and 1/3rd to the staff.

IV-Examination

19. Examination. - Examination for the grant of certificates of proficiency as a Boiler Operation Engineer shall be held by the Board of Examiners at such place and on such dates as may be notified by the Member Secretary from time to time in the Official Gazette.

20. Classes of certificates. - The certificate of proficiency as a Boiler Operation Engineer shall be of two classes, namely, First Class Certificate of Proficiency as Boiler Operation Engineer and Second Class Certificate of Proficiency as Boiler Operation Engineer :

Provided that in the case of operation of waste heat boilers, which are an integral part of process plant of a continuous flow installation, a person shall have to obtain a restricted certificate of proficiency as a Boiler Operation Engineer as provided in sub-rule (3) of rule 33.

21. Postponement of Examination. - When the day fixed for examination to be held according to the provisions of rule 19, is declared as a gazetted holiday or when for any other unforseen reason, an examination can not be held on the specified date, the Chairman may fix some other date for holding the examination and the same shall be duly notified for the information of the candidates for examination.

V-Certificate

22. Capabilities of holders of certificates. - (1) The Certificate of proficiency as Boiler Operation Engineer shall qualify the holder thereof to be incharge of a Boiler or Boilers of any type and size :

Provided that the boilers are so installed that each boiler is installed at a distance of not more than one hundred metres from the other.

(2) The holder of a certificate of proficiency as a Boiler Operation Engineer shall, for all intents and purposes, be deemed to have fulfilled the requirements of rule 4 of the Punjab Boiler Attendants Rules, 1961.

23. Endorsement on a certificate granted by a Board of Examiners of other States. - (1) A person holding a certificate of proficiency as Boiler Operation Engineer granted by a Board of Examiners under the corresponding rules of any other State may on application to the Chairman and on payment of a fee of five hundred rupees have the certificate endorsed for validity in the State of Punjab in case the Boiler Operation Engineer Rules for the grant of First Class and Second Class Certificate of proficiency framed by that State are not inconsistent with these rules. Such an endorsement shall be made by the Chairman.

(2) A Thermal Power Engineer, who possesses qualifications and experience as specified in sub-rule (1) of rule 33 and also possesses a certificate from the Power Engineering Training Society or any other Training Institute set up under the Indian Electricity Act, 1910, which is recognised by the Central Electricity Authority, on completion of training rendered by such institute, shall on application to the Chairman have the certificate endorsed for validity in the State of Punjab. Such an endorsement shall be made by the Chairman.

24. Fees. - (1) The candidates for examination for a First Class Certificate and a Second Class Certificate of Proficiency as Boiler Operation Engineer shall pay a fee of eight hundred rupees and six hundred rupees, respectively, which shall not except as otherwise provided in these rules, be refundable.

(2) All fees for examination for certificate of proficiency as Boiler Operation Engineer payable under sub-rule (1) shall be remitted to the Chairman by demand draft in favour of Chairman, Board of Examiners.

(3) The Chairman shall keep an account of all the fees received and of the payment made to the members of the Board of Examiners.

25. Refund of Fees. - (1) The candidates once admitted to an examination under these rules shall not be entitled to any refund or fees. Where a candidate is absent on the date fixed for examination due to some unavoidable reason the Chairman may allow him to appear without payment of additional fee at the next examination.

(2) A candidate, who has paid the examination fee, but is found ineligible for an examination, may apply within one year from the date of payment for a refund of the fee or he may be allowed to appear without payment of additional fee at any subsequent examination held within one year from the date of payment of the fee on his becoming eligible to sit in such subsequent examination.

VI-Application for Examination

26. Form of application. - (1) Every application for examination shall be in Form 'A' appended to these rules.

(2) The applicant shall fill and sign the Form in the presence of a Gazetted Officer who shall attest the applicant's signature. The application so signed shall be forwarded to the Member- Secretary at least thirty days before the date fixed for the examination and shall be accompanied by :-

(a) a copy of the degree or diploma, as the case may be, attested by the Principal of the concerned Institution or a Gazetted Officer alongwith the application for registration;

(b) original and one copy each of all the testimonials in respect of practical experience of the candidate;

(d) an attested copy of the certificate of age;

(e) demand draft in support of payment of the fee specified in rule 24 for the examination;

(f) any certificate granted to the applicant under these rules or a certificate granted by a Board of Examiners for another State Government or a Training Institute, as the case may be, for the purposes of endorsement referred to in rule 23; and

(g) two copies of recent bust photograph (size 50 mm x 63 mm) one of which shall bear the signature duly attested by a Gazetted Officer.

27. Candidates to produce satisfactory testimonials. - No candidate shall be admitted to an examination, unless he produces satisfactory testimonials from his employer or employers, as the case may be, certifying his experience, ability and good conduct for the whole period he remained under employment. The testimonials shall be got signed and countersigned in the manner specified in rule 29.

28. Essential statements. - A testimonial shall clearly state the capacity in which the candidate was employed, whether as an Apprentice Engineer, Supervisor, Assistant Engineer or Engineer and the periods of such employment stating the dates for which the candidate was so employed.

29. Signature and countersignature. - (1) A testimonial shall be signed by a responsible person with whom the candidate was employed and be countersigned by the owner, agent, Manager or Secretary of the Mill, Factory or Workshop or by such other persons as the State Government may specify in this behalf.

(2) Candidates who have undergone a course of training at an Engineering College or a Technical Institution must produce either the diploma of the college or institution or a certificate from the Principal or Superintendent of the College or Institution giving the period spent in completing the course.

(3) A testimonial in respect of service on a steam-ship may be signed by the Chief Engineer and countersigned by the Master of the vessel or may be in the form of a Seaman's discharge certificate issued by a Shipping Master.

(4) A testimonial of service rendered on railway boilers or boilers belonging to a Department of Government or a local body shall be signed by a responsible officer under whom the candidate has directly served and countersigned by the Head of the Department concerned and in the case of local body it shall be countersigned by the Head of the Firm.

30. Doubtful Testimonials. - If the Member Secretary has reasons to doubt the truth of any statement made in any application or testimonials, he may make such enquiries as he thinks fit to verify the same.

31. False testimonials. - If, on enquiry, the Member-Secretary is satisfied that any testimonial submitted by a candidate is false in any material particular, he shall submit his findings to the Chairman, who may by a written order debar such candidate from being admitted to any subsequent examination held under these rules :

Provided that, if a candidate has already been admitted to an examination, on the basis of such testimonials, he shall be deemed to have failed in such examination and any certificate granted to him as a result of his having been declared to have passed such examination, shall be forthwith recalled and be cancelled by a notification in the Official Gazette:

Provided further that before any certificate is cancelled under this rule, the holder thereof shall be given a reasonable opportunity of being heard in the matter.

32. Filing of copies and return of original testimonials. - Applications and copies of testimonials submitted by candidates shall be filed in the office of the Chairman. Original testimonials shall be returned to candidates as soon as possible,

VII-Age, Qualifications, Training and Experience

33. Qualifications required. - (1) A candidate for a First Class Certificate of Proficiency as a Boiler Operation Engineer shall not be less than twenty four years of age and shall not be admitted to an examination unless he possesses :-

(a) a degree in mechanical or electrical engineering recognised by the Institution of Engineers (India) for the purpose of exemption from sections A and B of the Associate Member of Institution of Engineers (India) Examination (A.M.I.E.);

(b) not less than two years' training in operation and maintenance of boilers and auxiliaries of an industry or power station; and

(c) not less than three years practical experience in operation of boilers having heating surface of not less than one thousand square metres.

(2) A candidate for a Second Class Certificate of Proficiency as a Boiler Operation Engineer shall not be less than twenty three years of age and shall not be admitted to an examination unless he possesses :-

(a) a diploma in Mechanical or Electrical Engineering recognised by the Institution of Engineers (India) for exemption from their studentship examination;

(b) not less than one year's training in operation and maintenance of boilers and auxiliaries of any industry or power station; and

(c) not less than three years' practical experience in operation of boilers having heating surface of not less than one hundred square metres.

(3) A candidate for a restricted certificate of proficiency as a Boiler Operation Engineer for operation of Waste heat boilers shall be issued in Form 'B' appended to the rules, mentioning clearly on the top of certificate "Restricted Certificate for Waste heat boilers only" which are an integral part of a process plant of a continuous flow installation. A candidate for such a certificate shall not be less than twenty four years of age and shall not be admitted to the examination unless he possesses :-

(a) a degree in mechanical or electrical or chemical engineering recognised by the Institution of Engineers (India) for exemption from sections A and B of the Associate Member of the Institution of Engineers (India) Examination; and

(b) not less than one year's training and three years' practical experience in operation and maintenance of Waste heat boilers which are an integral part of a process plant of a continuous flow installation.

34. Power to relax. - Notwithstanding anything to the contrary contained in rule 33, the Board of Examiners may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with regard to any class or category of candidates.

VIII-Mode of Examination

35. Nature of examination. - Oral examination and practical test for the First Class or Second Class Certificate of Proficiency as Boiler Operation Engineer shall be of such nature as to test the practical ability and technical knowledge of the candidates to be incharge of steam generating plants of power station or industrial units of all types in land use.

36. Subjects for examination. - (1) In addition to the subjects and matters specified for oral examination of the Second Class Certificate of Proficiency under sub-rule (2) of this rule, the examiner for the First Class Certificate of Proficiency shall, inter alia, satisfy himself that the candidate for the First Class Certificate of Proficiency has sufficient knowledge and practical experience in the following subjects and matters namely :-

(a) heat transfer as applicable to Boiler Technology, three modes of heat transfer, conductance and resistances, steady and unsteady state of heat transfer, combination of heat transfer mechanism, heat transfer surface arrangements, parallel flow, counter flow and cross flow, effect of lanes, tube spacing, tube diameters, affect of oil or scale, insulation and heat loss;

(b) combustion, heat of combustion, ignition temperature, combustion calculations, excess air, lossess, combustion system design, furnace; pulverized fuel fired dry bottom furnace, slage type furnace and oil fired boiler furnace;

(c) boiler circulation system, natural circulation, forced circulation and assisted circulation, design criteria of circulation system, factors affecting circulation and circulation ratio;

(d) thermodynamics of steam, reversible and irreversible processes, entropy, cannot cycle, rankin cycle and regenerative rankin cycle;

(e) coal processing and handling, preparation and utilisation of pulverized coal, type of pulverizers, factors affecting the milling plant performance, pulverizing systems, coal feeders, fire and explosion in mill circuit;

(f) general operating features of fuel oil system, trouble sooting of atomiser or oil guns;

(g) characteristics of different fans-axial, impulse, reaction and radial and their use for different purposes;

(h) advantages in using air heaters, advantages regenerative vs. recuperative, trouble sooting with air heaters, operation and maintenance;

(i) function of electrostatic precipitators, their principles, operational problem and trouble sooting;

(j) safety valve troubles and their remedies e.g. leaking of safety valves, incorrect popping pressure, blow down adjustment, spindle getting bent, hang up, hammer and buzzing, flutter or slight boundering when closing;

(k) function of soot blowers, types and their purposes, swing retractable soot blower, half retractable soot blower, wall deslagger, rotary blowers and pre-commissioning and post commissioning checks required;

(l) feed water treatment, boiler water treatment, silica control, chemical cleaning and stand by protection of high pressure boilers, priming and foaming of boilers, carry over in steam and the corrective measures adopted;

(m) operation and testing of instruments and controls in boiler plants, feed water control, combustion control, pulverized fuel firing and milling plant control system, furnace draught control, steam temperature control, utility of data logging and problem reporting and trouble sooting;

(n) efficiency test of boilers and calculation of various heat losses; and

(o) emergency operation of boilers and the minimum precautions to be taken before resorting to such operation.

(2) The examiner of an oral examination for Second Class Certificate of proficiency under these rules shall, inter alia, satisfy himself that the candidate has sufficient knowledge and practical experience in the following subjects and matters, namely :-

(a) unit of force, work, power, energy and their relationship in S.I. Units;

(b) familiarity with the provisions of the Indian Boiler Regulations, 1950 including calculations of dead weight safety valve, the weight and position of ball on a ever and weight safety valve;

(c) combustion, heat transmission, excess air, heat loss, circulation system in a boiler, properties of steam including ability to read steam tables and mollier diagram;

(d) principal types of steam boilers used on lands with special emphasis to industrial boilers and purposes and reasons for which different types of boilers are employed;

(e) functions of boiler mountings, fuel pumps, feed pumps, feed heaters, economisers, super heaters, reheaters, forced, induced and secondary draught appliances, stokers, burners, atemperators, dampers and other auxiliaries;

(f) operation of shell type boilers and water tube boilers with coal, oil and gas firing system with special reference to industrial boilers;

(g) feed water treatment and boiler water conditioning, deaeration, corrosion, PH (a number used to express degree of acidity of alkalinity in the solution), and total dissolved solids etc; and

(h) functions of measurement and controls in boiler plants and also the data logging on the operation of boilers automatic control.

(3) The examiner of an oral examination for restricted certificate for waste heat boilers under these rules shall, inter alia, satisfy himself that the candidate has sufficient knowledge and practical experience in operation and maintenance of waste heat boilers, which are integral part of a process plant of a continuous flow installation.

(4) If required by the examiners and to the extent deemed necessary, a candidate shall demonstrate either in a power station or in any industrial units his ability in the operation of boiler.

37. Assessment of work. - A candidate shall have to secure atleast fifty percent marks in the oral examination as well as in the practical test in order to be able to get a certificate of proficiency for First Class or Second Class, as the case may be, under these rules.

38. Oral examination and practical test. - Oral examination and practical test shall be conducted by the Board of Examiners with atleast two members of the Board of Examiners in addition to the Chairman or the Member Secretary.

IX-Grant of Certificate

39. Grant of certificate of Proficiency. - If a candidate passes the examination, his result will be notified in the Official Gazette and he shall be granted a certificate as soon as practicable after such publication.

40. Forms of Certificates. - A First Class Certificate of Proficiency, a Second Class Certificate of Proficiency and a restricted Certificate of Proficiency as a Boiler Operation Engineer shall be in Form 'B' appended to these rules.

41. Application for endorsement on a certificate. - An application for endorsement on the Certificate of Proficiency as a Boiler Operation Engineer for validity in the State of Punjab issued in a State other than the State of Punjab, shall be made in Form 'A' appended to these rules.

42. Record of duplicate certificate. - Duplicate of all certificates granted under these rules, shall be kept in safe custody in the office of the Chairman.

43. Identification requirement. - Every certificate granted under these rules shall bear a bust photograph of the holder thereof previously submitted alongwith his application under rule 26 and his signature and thumb impression and such other particulars as may be required for the purpose of identification.

44. Grant of duplicate certificate. - (1) Whenever the holder of a certificate proves to the satisfaction of the Chairman that certificate granted to him under these rules has been lost, stolen, destroyed or mutilated without any fault on his part, he shall, on payment of a fee of three hundred rupees, be granted a duplicate certificate. The duplicate certificate so granted shall, for all purposes have the same validity, as the original certificate.

(2) If on enquiry the Member-Secretary is satisfied that any statement made by he applicant for the issue of a duplicate certificate is false, he shall report the case to the Board of Examiners at its next meeting and the Board of Examiners may cancel the certificate or permit the grant as aforesaid of a duplicate certificate either immediately or after such period, not exceeding twelve months, as the Board of Examiners may think fit having regard to the circumstances of each case.

45. Application for duplicate certificate. - Application for a duplicate certificate shall be made to the Chairman with an affidavit attested by a Gazetted Officer or a Magistrate stating that the certificate granted under these rules, has been lost, stolen, destroyed or mutilated without any fault on the part of the applicant.

46. Invalidity of original certificate. - On the issue of a duplicate certificate, the original certificate shall cease to be valid and shall, if in the possession or power of the holder thereof, be returned to the office of the Chairman for cancellation.

47. Enquiry regarding certificate holders. - (1) If a District Magistrate or the Chief Inspector has reason to believe that an enquiry should be made into an allegation of incompetency, drunkenness, misconduct or negligence of duty on the part of a Boiler Operation Engineer holding certificate of proficiency under these rules, he shall either himself make such enquiry or cause it to be made by any of his subordinate officers. The District Magistrate may depute a Magistrate and the Chairman, an inspector of boilers to hold such enquiry.

(2) The proceedings shall be held in the presence of the person whose conduct forms the subject of enquiry and he shall have an opportunity of making any statement he may wish to make and of producing any evidence in his defence.

(3) The proceedings of any such enquiry shall be forwarded by the officer conducting the enquiry, where he is not the Chairman, to the Member-Secretary for consideration of the Board of Examiners.

48. Surrender of Certificate. - When an enquiry is being conducted under rule 47, the holder of a certificate granted in Form 'B' shall, on demand by the Officer conducting the enquiry forthwith surrender his certificate to the said Officer and the said Officer shall keep with him the certificate so surrendered pending the result of such enquiry.

49. Submission of proceedings before the Board of Examiners. - The Member Secretary shall place the proceedings sent to him under sub-rule (3) of rule 47 before the Board of Examiners at its next meeting and the Board of Examiners may allow the certificate to stand or suspend it for such period as it may think proper or may cancel the certificate permanently and the decision of the Board of Examiners shall be final.

X-Penalty

50. Cognizance of offences. - The owner of a Boiler or any person, who works or permits or causes the Boiler to be worked at any time in contravention of these rules, shall be punished in accordance with the relevant provisions of the Act.
