The Punjab State Electricity Regulatory Commission Fund Rules, 2006

(a) "Act" means the Electricity Act, 2003 (Central Act No. 36 of 2003);
(b) "Commission" means the Punjab State Electricity Regulatory Commission;
(c) "Drawing and Disbursing Officer" means an officer designated as such by the Commission to draw and make payments on behalf of the Commission;
(d) "Secretary' means the Secretary of the Commission; and
(e) "State Government" means the Government of the State of Punjab in the Department of Power.
(2) The words and expression used in these rules, but not defined shall have the same meaning as assigned to them in the Act. 3. Contribution of the Fund. - [Section 103] - (1) The State Government hereby constitutes a Fund to be called the Punjab State Electricity Regulatory Commission Fund. (2) The present Bank Account of the Commission shall stand transferred to the Fund. 4. Constitution to the Fund. - [Section 103] - The following shall be credited to the Fund, namely :-(a) any grants and loans made to the Commission by the State Government under Section 102 of the Act;
(b) all fees received by the Commission under the Act; and
(c) all sums received by the Commission from any other sources, as may be decided upon by the State Government.
5. Application of the Fund. - [Section 103(2)]- (1) The Fund shall be applied for meeting-(a) the salary, allowances and other remuneration of Chairperson, Members, Secretary, Officers and other employees of the Commission;
(b) the expenses of the Commission in discharge of its functions under Section 86 of the Act; and
(c) the expenses on objects and for purposes, authorized by the Act.
(2) The Fund shall not be used for any purposes other than those specified in sub-rule (1). 6. Operation of the Fund. - [Section 180(1)] - (1) The Fund shall be operated by the Drawing and Disbursing Officer. (2) Every receipt of the Commission shall be credited to the Fund by the next working day positively. (3) Every withdrawal from the Fund shall be made against proper authorization and sanction from such authority, as may be specified by the Chairperson. 7. Maintenance of the Fund. - [Sections 103 and 180] - The Fund shall be maintained in a Nationalized Bank situated at the Headquarters of the Commission. 8. Budget of the Commission. - [Sections 106 and 180] - The Commission shall prepare in Form 'A', appended to these rules by the 30th November of each financial year, its budget for the next financial year, showing the estimated receipts and expenditure of the Commission as well as the revised receipts and expenditure of the current year and forward the same to the State Government. 9. Investment in gainful deposits. - [Section 103(3)] - The Drawing and Disbursing Officer, if he deems appropriate to do so, with the approval of the Secretary, may invest any amount available in the Fund in any short-term or long-term gainful deposits in any Nationalized Bank with a view to earn profitable returns. 10. Expenditure from the Fund. - [Section 103] - While incurring expenditure from the Fund, the general principles and proprietary laid down in the Punjab Financial Rules will be followed.Form 'A'
