The Wild Life Advisory Board (Terms of Office) Rules, 1974

Rules1. (a) These rules shall be called the Wild Life Advisory Board (Terms of Office) Rules, 1974. (b) They shall apply to all persons nominated to the Wild Life Advisory Board under Section 6(1)(b), 6(1)(e) and 6(1)(g) of the Wild Life (Protection) Act, 1972. (c) They shall come into force on the date of publication in the Official Gazette. 2. (1) The term of office of a member of the Wild Life Advisory Board referred to in clauses (b), (e) or (g) of sub-section (1) of Section 6 shall be three years from the date of his appointment. A member will however, be eligible for reappointment. (2) When a member of the Board referred to in clauses (b) or (g) of sub-section (1) of Section 6 resigns or dies or is removed from office or becomes incapable of acting the State Government may, by notification in the Official Gazette, appoint a person to fill the vacancy till the term expired. 3. (a) A member of the Board nominated under Section 6(1)(b), 6(1)(e) or 6(1)(g) may resign his office by writing under his hand addressed to the Chairman.
(b) The office of such member of the Board shall fall vacant from the date on which his resignation is accepted, or on the expiry of thirty days from the date of receipt of intimation of the resignation, whichever is earlier.
(c) The power to accept the resignation of a member of the Board shall vest in the Chairman, who shall report to the Board at its next meeting.4. The State Government may, after such enquiry as it may deem fit, remove any member nominated under Section 6(1)(b) or 6(1)(g) from his office. A member nominated under Section 6(1)(e) may be removed by the Director of Wild Life Preservation on the recommendation of the State Government: Provided that removal may be made in case the member:-
(a) Absents himself without leave from more than three consecutive meetings of the Board, or
(b) Commits a breach of any of the provisions of the Wild Life (Protection) Act, 1972.5. (i) The non-official members of the Board shall get travelling and daily allowances as admissible to class I officers of the State Government.
(ii) Where concessional tickets are allowed for return journeys by train, the travelling allowances shall be restricted to the actual cost of return tickets plus incidental charges.
(iii) A member of the State Legislature who is a member of the Board shall not be paid any fare in respect of a journey by rail or road if he is entitled for free passes for such journey.
(iv) If a meeting of the Board is held during a session of the Legislature and at the same place where such session is held, a member of the Legislature who is also a member of the Board shall not be entitled to any daily allowance.
(v) The Secretary to the Board shall be the controlling authority in respect of payment of allowances. The Travelling Allowance Bill of the Member of the State Legislature shall be got countersigned by the Secretary, Rajasthan Legislative Assembly.6. The quorum for a meeting of the Board shall be 25 percent of the total number of members excluding the Chairman.
