The Code of Civil Procedure (Tamil Nadu Amendment) Act, 1970
Tamil Nadu Act 15 of 1970
Object & Reasons6
|Statement of Objects and Reasons. - Under sub-section (1) of section 123 of the Code of Civil Procedure, 1908, a Rule Committee shall be constituted at the town which is the usual place of sitting of each of the High Courts referred to in section 122. Clause (d) of sub-section (2) of section 123 of the said Code, inter alia, provides that such Committee shall, in the towns of Calcutta, Madras and Bombay consist of an attorney. The High Court, Madras considers that the number of attorneys has dwindled considerably in the Madras High Court and it is very difficult to find a suitable person to fill up the vacancy in the Rule Committee from among the attorneys. The High Court, Madras has, therefore, suggested that the Code of Civil Procedure may, suitably, be amended so as to provide for the appointment of an advocate member instead of an attorney member. 2. The Bill seeks to achieve the above object. Published in Part IV-Section 3 of the Tamil Nadu Government Gazette Extraordinary, dated the 13th September 1970.|
