(a) "Act" means the Tamil Nadu Private Universities Act, 2019 (Tamil Nadu Act No. 14 of 2019);Words and expressions used in these rules, but not defined, shall have the same meanings assigned to them in the Act. 3. Application for establishment of a Private University. - (1) Any sponsoring body desirous to establish a Private University shall make an application to the Government, in the Form annexed to these rules along with a detailed proposal containing an outline of the purpose and vision of the proposed Private University. (2) Application for the establishment of a Private University shall be accompanied by a Project Report. (3) Application shall be signed by the person authorised to authenticate instruments on behalf of the sponsoring body. (4) The sponsoring body shall submit seven hard copies and one soft copy of the proposal along with requisite annexures, enclosures, undertakings and declarations. (5) No application, referred to in sub-rule (1) of rule 3 above, shall be entertained, unless a fee of Rs.12,00,000/- (Rupees Twelve lakh only) is paid into the following Head of Account of Government of Tamil Nadu :-
"0202 - 01 - 103 - AH 227 05"Provided that a portion of the fee amounting to Rs.6,00,000/- (Rupees Six lakh only) shall be refunded to the sponsoring body, if the Government decides to reject the application under Section 8 of the said Act. (6) On receipt of the application from the sponsoring body, the Secretary to Government in-charge of Higher Education Department, shall refer it to the Expert Committee. The Expert Committee shall examine the proposal and may call for such other information from the sponsoring body, as it may deem necessary. (7) The Expert Committee shall make recommendation on the establishment of Private University to the Government. The Government shall take a decision on accepting or rejecting the proposal or seek modification of the proposal or additional information. (8) The Secretary to Government in-charge of Higher Education, shall inform to the sponsoring body about the decision of the Government on the proposal through a Letter of Intent, a Letter of Regret, or a letter seeking modified proposal or additional information, as the case may be. 4. Land for the establishment of Private University. - For the purpose of establishing a Private University, the concerned sponsoring body shall possess contiguous land of not less than one hundred acres in the name of the sponsoring body at the time of submission of the application along with the proposal. The said contiguous land shall be transferred in the name of the Private University within a period of three months from the date of inclusion of the Private University in the Schedule to the said Act. On completion of the said name transfer, the Government shall publish the notification in the Tamil Nadu Government Gazette Extraordinary for the commencement of the Private University. 5. Establishment of Permanent Endowment Fund. - (1) On receipt of Letter of intent from the Government, the sponsoring body shall earmark fifty per cent of the Permanent Endowment Fund i.e., a sum of Rs.25,00,00,000/- (Rupees Twenty five crore only) and keep it in a separate Fixed Deposit in the name of the sponsoring body. The remaining fifty per cent of the Permanent Endowment Fund shall be deposited in the name of the Private University within a period of three months from the date of inclusion of the Private University in the Schedule to the said Act. Then, the initial deposit of a sum of Rs.25,00,00,000/- (Rupees Twenty five crore only) made in the name of the sponsoring body shall also be transferred to the Permanent Endowment Fund of the Private University. (2) The Permanent Endowment Fund shall be maintained in a nationalised bank, approved by the Government from time to time, in the form of a fixed deposit and shall be in the joint name of the University concerned and an officer specified by the Government for the purpose. (3) The Permanent Endowment Fund shall not be liquidated without the prior permission of the Government. 6. Sitting fees and allowances for Chairman and members of the Expert Committee. - The Chairman and the members of the Expert Committee shall be eligible for a sum of Rs.5000/- (Rupees Five thousand only) and Rs.3000/- (Rupees Three thousand only) respectively, as sitting fee. 7. Manner of preparation of Project Report. - The project report shall consist of the following, namely :-
(a) justification for the necessity of establishing the proposed Private University;
(b) the details of the sponsoring body and the particulars of registration of the sponsoring body;
(c) the list of the higher educational institutions already established by the sponsoring body;
(d) the financial resources, scheme for mobilising resources, generation of funds;
(e) complete details of the land acquired for the establishment of proposed University;
(f) details of building, other infrastructure facilities and procurement of equipments, proposed to be owned or created as required under the provisions of the said Act;
(g) nature and availability of facilities, details of plans for campus development such as construction of buildings, development of amenities and infrastructure facilities and procurement of equipment to be undertaken before the University starts functioning and phased programmes for the first five years;
(h) proposed fee structure for the different courses;
(i) system proposed to be followed for admissions to the courses of the study, appointment of teachers and other employees; details of off-campus centres and study centres;
(j) details of national, international collaborations of the proposed University, details of programme related to local needs (or) for the benefit of farmers / women / industries located in the State;
(k) details of application fee, details of concession or rebates in the fee and scholarships if any;
(l) the commitment of sponsoring body to follow the norms of the regulatory bodies;
(m) details of minority status, if sought for, by the proposed University;
(n) details of status of fulfilment of such other conditions as may be required by the State.
